Resignation & Transfer during Probation Period in Bahrain

Dear Expat Members
I joined a company 2 months ago, so far I have not been paid any salary. Now I would like to resign during my probation period and find another company. When I intimated this to my employer they refused to accept it saying they will not cancel my visa. Now my question is

1)I want to resign and start applying elsewhere, Can my employer stop me from doing that?

2)Can I transfer from old to new company without leaving Bahrain?

3)How long can I stay in Bahrain after my current employer accepts my resignation?

Understand you are anxious but please, next time, search the forum.  I have answered this exact question literally hundreds of times and even created a sticky for the most frequently asked questions.

Having said that:

1) No they can't stop you.  Make sure to send resignation via registered mail in writing and retain the pink slip - just in case if there are issues later
2) No.  You need employer permission to transfer if you have worked with them for less than 1 year.  After one year, you don't.  However, if they cancel your visa, your new employer can apply for a visa for you without you needing to leave Bahrain
3) This has nothing to do with resignation and everything to do with visa.  Once visa is cancelled, you will have 30 days to either get a new visa or leave Bahrain

Thank You XTang, your help is much appreciated. Now  I have a clarity on how to proceed further.

Just one more clarification.
My passport is with the company, they took it from me to stamp visa. Do they need my Passport now to cancel Visa or I can take it back right away?

Passport not needed. They can cancel visa in system. But you or they may want to get a cancelled stamp on visa in passport. In that case, it will be needed.

My company said they would deduct 60bhd fee they paid to change my visit visa to company visa from my salary, Do they have any grounds to do that?

No. But you can't stop them without filing a case at the Ministry of Labor.

Hi Xtang!
Please i need your advise. I received a call from a police station asking me to come and bring with me my car.. i asked them why and what was the problem but they did not tell me anything. I need to go to the court and check if there is any case against me. If i will go to police station are they going to detain me?
Please advise what shall i do!

I can't say without knowing all the details. It could be that you did a hit and run or had an accident or it could be a case of mistaken identity. You being detained is dependent on what the issue is.  But you really don't have a choice. You have to go but it's your choice to go alone or to go with a lawyer.

Appreciate for your quick reply. I went to the court and got my case number. But unfortunately i was not able to get what was the case contained due to restrictions. But the lawyer in desk has told me that the case is already closed and even i don’t have any court orders for the police to catch me or stop me. I came to know that the case is regarding the unpaid house rental. This happened when i left the house with contract still under my name. My colleages stayed there for about 5 months without paying the rent and they were forced to leave. With the police call issue what should i do. Please advise.

Go there and see what they want. I am confused as to why they want you to bring your car.... That would only happen if the court has ordered them to seize your movable assets in lieu of unpaid rent.  So worst case, they keep car and not you :).

Hi XTang!
For few days i went to the court to verify if i have a case or any court orders. I found out that the case filed against last 2005 was already closed and i checked with police station if there is any court orders against me but i found out that there is none. I wonder why there was a call for me in isa town police station and asked me to take the car there. I went there 2 times already but unfortunately the concern officer was not present. Please need advise.

It must be something new. Something as simple as a complaint maybe.  You can wait and see if they call you again and tell them you went twice or you you go again and check.

The employer might file case against you and you will not be able to come back to Bahrain.

@XTang Basically how many days notice should I give an employer when planning to resign during probation time.

Please check your job contract. It will mention notice during probation and after probation. Legally it is just 1 day's notice at the time of probation.
