30% ruling - working in Netherlands and living in Belgium

Hello everyone,

I am an indian living and working in belgium and my spouse from India wishes to join me in Belgium.
My spouse has found a job in the Netherlands, while she was still in India. In this case, can she come to Belgium on Spouse visa and work in the Netherlands? (provided that her employer is ready to process her NL visa) will she be eligible for 30% ruling in this case? or does she need an address in the Netherlands? Note that I live close to NL border and NL-BE commute is manageable.

Hi and welcome to the Forum.

Not quite sure how you can manage this; if your wife does not live in the Netherlands, then she will not be registered with the Gemeente and won't have an active BSN number, so won't qualify.

That said, for other (albeit non-tax reasons), they do provide for cross-border workers, so perhaps you can make a special case for your wife.  My advice is to get your wife's future employer to speak to the IND and Belastingdienst and see if their is any precedence that would enable this to proceed.

No, you need to work for a Dutch employer who is registered with the IND and live in the Netherlands.
