I'm from India and my employer brought me from India to Malaysia for a 2 year contract. After the completion of one year, my manager told that the company is in loss and planning to close the IT sector and he has given us two months of notice period. Due to this pandemic, we requested for three months. They agreed for it. Now at the end of two months they are telling they won't provide NOC. I'm not sure why they decided not to give. Is there any other solution for me? Is it legal for them to fire me and not provide NOC also? They have terminated me because they don't have projects and not because of my performance. Please help by providing some suggestions. Can I atleast apply for dependent pass (through my spouse company) if I don't get the NOC?

Sorry to here that what you are going through ,its not mandatory for your employer  to provide the NOC . If you have good terms with your employer request them once again for NOC . If not you will have to exit the country and start process your Dependent pass. with out NOC they wont process the DP also while you are in Malaysia.

Hi Swapnabhavanam,

Thanks for the reply. So, for the DP also I must need to exit the country is it? Can't I apply for DP once my EP expires?

Hi Padma, no you cannot apply. Even if the EP is expired you will still need to provide the NOC for DP process .
