Is a Northern Cyprus citizen considered non-dom in Republic of Cyprus?

Hi,

I have an interesting question trying to help out a friend who is a Northern Cyprus (TRNC) citizen. Both his parent are Nothern Cyprus citizens living there. The father was born in the South, and possesses the Republic of Cyprus passport, but is living in the North. Neither are Greek but Turkish people.

Now he wants to apply to the non-dom program in the south of the island for taxes purposes. Is he eligible?

DO you mean he wants to be non UK domiciled, for IHT purposes? Does he live in the UK or Cyprus?

UK assets are always subject to IHT.

If his father is Cypriot then he can inherit his father's domicile, once he has left the UK, but it depends when he left.

SO, it is possible but he needs professional help

He was born in the UK and lives in UK. However he has lived in North Cyprus. The amount of time that has passed since he last lived there was 14 years ago.

The strange thing is the North is considered separate country, so would the South even have access to the last time he lived in the North?

He has no UK assets.

He sounds UK dom. If so his estate anywhere in the world would be subject to iht.

Although cyp is divided politically it is not recognised as two countries, someone from the trnc is still Cypriot. If he moved to cyp he might be eligible for non UK domicile after 5 years

Not sure if he would be UK domicile. From what I was told he can pass the overseas test and non-UK resident test if he leaves the country and doesnt enter for the whole year.

Not sure what the point of IHT at this point. He hasn't inherited anything or have anything in the UK. No property, no car. Nothing.

What's your business in an illegal state recognised only by Turkey? The so-called "TRNC" are illegally occupied areas, there is no citizenship. Your business there is illegal

The "south of the island" is where the Cyprus Republic is

Knowing that he crossed the border isn't enough to make a determination. He might have stayed 1 day in the North or 1 year. How they going to know when he left the country via the airport in the North?

I guess it depends on what Turkey  administration do with the passport.... ie stamped physically or electronically... an how old the passport is... i really dont know if newer passports retain all the older  passport movements

I have also recently learned that the Non Dom scheme is determined by being in Cyprus for upto 17 years in the last 20 years.. over 17 years in the last 20 years you will be classed as domiciled in Cyprus.
