Not able to get DP from EP due to NOC

Hello everyone. My husband's company decided not to provide NOC. I'm applying for employment visa for myself as I have got a job here. Is there any way that my husband can get a dependent visa and stay with me? Because in India situation is really going worse and can't even imagine to exit the country and travel back once his dependent visa is approved, also he can't leave me alone here in this pandemic situation. Do we have any solution? I see many posts that myentry pass is getting rejected because of India situation. Does Malaysian Immigration or Indian high commission can help us in this? Please help as we are in lots of stress due to this.

why your husband need NOC for dependent pass? sorry I am also confused

That's what MDEC asks for. If we get any visa from EP, NOC is must from the previous company. No matter if we apply for DP or EP

Hello Padma,

I am really sorry for this situation that you face. Actually I had the same situation regarding getting the NOC from my previous company, I wanted it to join another company and get a new EP visa to avoid going out of Malaysia in this hard times but they refused to give it to me. I almost contacted most of the involved  parties such as Malaysia immigration, my country immigration and  labour office but all of them had only one reply that this is beyond their service and it’s a matter related to my company itself and I should arrange the situation with them to give me the NOC and there is neither official party nor any law in Malaysia can obligate a company or interfere between it and its employees to give such NOC. So you can try to speak to your husband’s company again and again and explain the whole situation so that they might give it to you.

Hi Padma,

Sorry for ur situation!

Seems like ur hasband unfortunately lost his job and now he needs to be on DP from EP. Thats really nonsense of the emplyer if they r not giving the NOC for that. Just appy pressur on them. All reputed companies provide but not the body shopping ones. Once u start pressuring, they wud budge. I hv seen such exmaples.

We've tried of all options available and no use of that. They're so stubborn that they shouldn't give the NOC. Now I'm just trying if immigration will help or give some exception for him to stay here and apply for DP instead of exiting. Situation in India is so so bad that we can't imagine of travel to and fro.

Once u leave the country, u cannot come back that's for sure especially when u don't have a visa. it will be difficult to get an entry approval without a valid EP or DP. it's a weird situation for u and I wish u well.
