Help on Verification against EU law?

hi all. I am from Singapore and my bf is a Hungarian who will be moving to Netherlands to work. He had worked there for 4 years in early 2010 and has no problem getting a job there again (he already has soft offers and connections there)

I am waiting to apply for the verification against EU visa but am still slightly confused.

With the facilitation visa how long can I be in the Netherlands? And can I use the time in Netherlands to count towards "living together" with my bf? But under the ind site for application for verification against EU it doesn't state for unmarried couples. How to navigate that part?

And do the evidence such a tendency agreements or bills with the same addresses need to be officially legalized (I read to submit electronically so maybe it doesn't have to be) as we only have pictures we took of the printer papers and I am not sure if we kept the papers. Ps: in my country we tend to live at our partners houses without changing it officially so sometimes it's hard to prove that.

The tendency agreement we have for both our names was dated may 2020 but we have moved after that. And my own address was reverted to my own family home. Do they ask to show subsequent addresses or just 1 proof of same address is enough?

And verification against EU doesn't need the basic civic integration exam too right?

I am hoping this route will not let us be apart for too long. I am told if this route doesn't work I will need to go via the mvv route which does not allow me to be in the Netherlands at all while in application.

Hi and welcome to the Forum.

The full process you need to follow is described on the Dutch Government website; this link will take you straight there.  I suggest you begin watching the small film at the start, then work your way through it.

To answer your questions:

Facilitation visa - 90 days.  You do not need to be married to apply for this; you do need to prove a meaningful relationship, so evidence of having lived together.

Legalised - no.  Legalisation is for Government-issued documents i.e. birth certificates, marriage certificates etc.

Tenancy agreement - supply what you have - you do have to provide information.  Go back to your previous landlord and ask them to provide copies of any tenancy documents.

MVV - no, you do not need an MVV.  With regards to finding work; your partner is lucky, Covid has caused severe issues in the Netherlands and many people find themselves out of work or working from home if they are lucky enough to have kept their job.  However, I would strongly advise you to learn to speak Dutch and if you want to find a job, then start learning now.

As the partner of an EU citizen, you do not have to do MVV under any circumstances (link).

Hi cynic. Thank you for your welcome and reply. I have scoured the site and also tried calling the Dutch consulate here in Singapore but still I have some queries.

As far as I read I am eligible to apply for verification against the eu law and am exempted from the civic integration test and mvv application.

The facilitation visa only lasts 90days and the ind can take up to 6 months to process and come to a decision for verification against eu law. How to navigate this if my facilitation visa expires before I get a confirmation from ind? Or should I stay in SG until I get an answer from ind?

I read that you and your partner should  make a appointment with ind in Netherlands to submit an application but as per above questions if I can’t be in Netherlands due to whatever and I don’t want to risk my overstay in NL and get deported and barred forever haha

Hi again.

Not sure where you get the 6 months from; normally a maximum of 90 days, if for any reason it takes longer, you can ask to extend your 90-day visa.

According to this site :

Decision on your application
The IND has 6 months to decide on your application for verfication against EU law. This period is called the decision period. It is specified by law. You will receive a letter stating the date by which the IND will decide on the application.

Hi again.

Your link doesn't work yet, but I found the relevant part of the IND website that it comes from.  As I said, from what people have told us on here, the decisions normally take up to 90 days and they write and tell you if they anticipate it taking longer; they do allow you to apply to extend your Schengen visa if such a thing happens.

The IND does have a contact page where you can contact them to ask questions if you are not sure about something; they also have a Twitter feed where they will answer general questions.

OK got it. I have dropped them a msg on their site and I will wait for them to reply. My bf will return to nl this weekend so he can ask them as well. Thank you for your help! I am feeling more confident now :)

Btw  i read that I only need to submit evidence of our relationship like photos, tenancy agreements Ann’s documents. But I did not read anything about my birth certificate, or non-marriage cert ?
