Nationality application- Interrupted work

bc2910

Hi there,

I work in Belgium under the single permit regime and I would like to know what would be the implications of having 2 weeks of interruption between two jobs for the nationality application.

Thank you

I think nothing will happen as long as you can proof 468 days working.. The day you apply.

Also since now you don’t have 5 years of uninterrupted work, you need to go through the integration process (course + language)

@bc2910

Technically, 2 weeks of interruption is a valid reason to reject your application.

If you are lucky enough and they ignore the gap, it may be processed.

However, if you have more than 468 work days in the last 5 years, I recommend to complete A2 and A2 FR/NL language along with the integration certificate. In this way, the gap between your employment will not be hurdle for your application to be processed.

Hope this helps

It is a bit strange to understand interruption in job issue while applying for Belgium nationality.

I worked as a freelancer (with a professional card) for 4.5 years out of last 5 years. I was without a contract for more than a month multiple times. They just checked no due of VAT, Tax and Social Security at the time of nationality application. They didn’t check individual monthly invoice etc. They didn’t ask for any language proficiency certificate. My friends worked as a freelancer have the same situation and there was no issue.

@Jimsen

the interruption is actually caused by the residency. in many cases, people are given residency due to full time work (limited duration contract based work permit and residence permit in combination to limited single permit as in recent years)

thats why if they interrupted their work means the residency is void automatically as it is given due to work.

in the case of freelancer is different story as indeed you are working freelance so as far as all tax/social contribution are paid then nothing is interruption.

@Peterjohn123 : Correct.

For me, there was no relation between the contract duration and freelance card validity.

The things can be different now.
