Hallo there,

I am from Singapore. Recently, my spouse was hired by a company in Germany and she has to base in Germany in a few months time once her employment visa is ready. My child and I will be applying for Family Reunion Visa (FRV) so that the family can move together to Germany. However, I am currently employ in a local company as an engineer and management role, and wish to continue to work for my company remotely when I am in Germany. I will still be receiving my salary in Singapore and pay the local tax.

  1. May I know is it illegal for me to work under FRV?
  2. Do I need to apply for any visa working for Singapore while living in Germany?
  3. My employer is not registered in Germany, does my company has to pay the German tax while I am living with my family and going to work there for long time?
  4. Does my employer needs to apply the Permanent Establishment?
  5. Is it possible for me to pay my tax in Germany? or which is better?

  6. Please kindly advise and how shall I proceed?
  7. Thank you.

A FRV usually includes the right to work.

However, the formal setup of what you have in mind will be quite complicated:

  • Your Singapore income will be taxable in Germany. (Check with your employer and local authorities how they deal with this in Singapore!)
  • Since you have no employer in Germany (who takes care of tax and social security deductions - and pays half of the latter), you will be classified as freelancer or need to register a business and you have to pay the full dues from your own pocket.
  • If you are less than fluent in (buerocratic) German, you will have to engage professional help for the associated formalities (registration, accountancy, tax declarations, etc.) and pay the fees for this.

These things are far more complicated here than in Singapore, and the costs make such a proposal unattractive in most cases. In addition, to set things up will take several months - the residence title and work permit alone can take three months or longer, during which time you cannot yet work.
