i am a foreigner who want to get plot and build a house on philippines, i know foreigners can't buy plots, so i want to get leased plot.

what shall the contract looks like, and what is the maximum period, is it 50 years? or can go longer?

what kind of authentication i need for the contract?

finally, who own the house that i will build after those 50 years?

Single or married? Married put the plot in your wifes name and everything you spend money on is hers, you can't lease from your wife here.


If you are single and only want to lease land? Good luck finding some one you can trust and then finding a decent attorney here capable of completing required docs, anywhere for that matter.


Any contract by law is drawn up with agreement within the law by both the parties consent and within the law of the respective countries. Stated so in the contract that both parties sign and witnessed.

/ As a foreigner all I needed for authentication was my passport, Australian drivers license and the ability to hand over cash.

BTW a decent attorney is not easy to find here.

As for after 50 years? Will you be around? I think it's important to firstly put within the lease the right to sell the lease and chattels (buildings/personal cr@p on the lot) to another party/investor and a power of attorney to your executor that will control your wishes once burnt or buried. Many caveats in the lease.


The other thing I did was place a mortgage/caveat on the title to prevent the land/lot being sold without my or my executor signing off on that. The Property will eventually be sold and equal shares go to my partner, my 2 kids and my sister (executor) after I am pushing up the daisies.

The better half (the lease owner) that gets a one quart share, some 7 to 8M pesos in his pocket is not complaining and the balance to my direct family, but not to share my wealth in Australia, that's for my kids and sis.


Draw up your lease and commitments very carefully as you only get one shot at this,,,,,, if you can even find someone to lease you a lot.

You will never own the house..period. I had a lease drawn up before I got married. A lawyer can draw up a lease. 25 years with the option to renew. I've heard there are zones around Subic that you can lease directly from the government .. Maybe start there if you are single.Maybe start here : https://clarksubicmarketing.com/subic-info/

Go to rural areas where land is so cheap that you can afford to lose it and then build a simple house on it so cheap that you can afford it. I recommend to google for earthbag homes. You can setup something really nice but unconventional looking for as little as US$ 10K. 


Also i doubt that the house is worth anything after even 30 years, average buildings degrade quickly to a level where it hurts even the value of your land because you have to tear down the house first.


If you dont want to live like a Filipino but have little money, don't come here. It will be much more expensive here to life like a westerner.

@Enzyte Bob  Exactly the opposite. Earthbag homes are much stronger than the disgustingly bad hollow bricks typically used in the Philippines. Earth back homes are fire, earthquake and typhoon prooved. The PH government even had some big  programs to assist  earth bag building of government houses and schools after Supertyphoon Yolanda.   


I say it is just the usual ignorance against change of the the Filipino lifestyle that they aren't more popular in rural areas.

@Mikko Alfonso There are numerous ways you can actually obtain a plot of land and safeguard yourself.

Whilst it is true you can not entirely own land as a foreigner, you can create trusts which give you 100% title of the land in question.


I have done it and have to do it again in due course.


Having a child born in Pinas or born anywhere in the world to a Filipino mother is a great help !!!


Although you will always love your child & wife, you never know what your going to get as life progresses.


I have lived in South East Asia since i was 13 or 14 where i landed in Mindanao & have listened to many an old man tell his tales and have learnt to live & tell mine.


May i suggest you create a "Trust within a Trust" & maintain Power Of Attorney.


Then when baby is born or a child you can entrust it with whilst maintaining Power Of Attorney you will always in effect "OWN THAT LAND TITLE" "Insitu".


This is Philippines law that Oligarchs maintain and have done since 1889 to protect their land.

Its a wonderful historical Law but thats beside the point.


In Australia at the Canberra Embassy i have just gone through an exhaustive 2 year hiatus to get Pinas Citizenship by way of Non Quota Visa.


Most people say you can not become a Citizen when not native to land, but thats Bullshit !!! YOU CAN !!!


If you are Australian, contact Lorraine at the Embassy or go to RBC in Manila when you have time and talk to Daniel when you eventually get told "NO TO HARD, NO NO NO NO"...ITS TOO HARD FOR THEM, TIME CONSUMING AND EXHAUSTIVE for them.


Ya gotta love Filipino time.


In short, go to a "Land Lawyer" & ask to set up the above, he will know what you mean if you pay the right amount of money for the appropriate knowledge to safeguard yourself until the end of your days...then just give it away...you will be dead so whats it matter...unless you have a child to give it to...

Hi WHITEY,

I am a visitor here (tourist) and can only renew my visa 2 months at a time in my local immi office. I believe you needed to have a visa for 12 months but read somewhere that was reduced to 6 months to apply for a local drivers license.

I have only been stopped once in these last 3 years and never before that and simply showed my Australian drivers license and waved on. I don't carry my passport so they would have to do a lot of inter departmental investigations to see I have been here more than 3 months. 90 days on a foreign license.


Aside Ben does most of the driving these days as he is not white meat if there is an accident. In 2 or 3 years I'll probably apply for the SRRV and get a local license then.

@WHITE ASIAN thanks for the info. We are thinking about buying here by using a trust for the longest time but don't know how. Could you advise where can we find a trustworthy Land Lawyer in Metro Manila? Our kid is Filipina, but not yet 18
