Hi my name is Mikenzi. I need some serious help. We’ve been looking everywhere and honestly the Atlanta consulate for Brazil hasn’t been helpful at all.


I am trying to return with my husband to Brazil February 6, 2023. He is Brazilian and I am a US citizen.


I first went to Brazil March 10, 2022 and extended it to the full 180 days, however I technically left the country with one day left to be there as a tourist. I’m supposed to have to wait until a year after my first entry into Brazil to be able to enter as a tourist again. That day would be March of 2023.


I now want to go back with him to Brazil but in February but with only 1 tourist day left.


my question is


1) can I re-enter on a tourist visa with only one day left on my tourist “visa” if my intentions are to go to the Policía Federal and apply for residency the same day?


2) has anyone heard of something similar to this situation?


3) will I be penalized in any way if I don’t tell the authorities about my marriage when I enter?

01/12/23 Hi, Mikenzi. Two questions that are important to evaluate your possibilities:



  1. Is your husband in the United States with you now?
  2. Have you registered your marriage at the Brazilian Consulate General?


Your answers to those two questions will determine the answers to your others. Looking forward to your response.

And more likely, the paper runs to the Consulate, you might need a Despachante, or gopher. 


Guaranteed you will find one in Atlanta.  They know all shortcuts to get your ViSA.

I'm not sure why are you not getting your VITEM XI visa now, in the USA through your consulate, then an easy trip into Brazil, an appointment with the PF, and you're done with your RNM.

Absolutely right - that would be her best bet.  That's what's behind my questions:  if her husband is already back in Brazil,  that will cause issues with with both registering the marriage and applying for the VITEM XI; if the marriage has been registered, that still complicates the visa, but there may be workarounds.

I don’t think you need a visa to travel to Brazil any more from the US. To make matters easier, get your marriage certificate in both countries.

A Visa Waiver is still a Tourist Visa and has the same limitations.   It's just electronic.


A VITEM XI provides much more liberal terms for length of stay, and facilitates the CRNM process at the Polícia Federal.   The most recent reports indicate that it may even be all that the PF require, as was the case with the old VIPER.

@sjpetzold lf l understand the law correctly, you don’t technically need a visa but you can only stay 90 days at a time from the stamp date  in your passport. If you do the extension like she did, you can’t return for a year.


In any case l would strongly recommend not trying to get the permanent visa after you are already in Brazil.

lt can be a nightmare. If she thinks the Consulate in Atlanta is difficult wait until she tries to deal

with the authorities in Brazil.
