TIE in Spain

My family and I are going to Spain next week to get our TIE.

My husband and 2 children have NLV so that shouldn't be a problem but I have a work visa.

I have been to the social security in Spain and have got my Social security number so that I can be self employed.

Do I need to actually register with the autonomo to get my TIE?

My Spanish solicitor says  I do and that as soon as I register I have to start paying the autonomo of 300 euros per month. But we have to sell our house in England before we can start living and working in Spain. So I will be paying the autonomo until probably July with out working in Spain.

Any advice?

We seem to get somewhere and then the next day there is something else that we have to do or something else that we have to pay for.

It's unfortunate as I was granted my work visa 2 half months before my family was granted their NLV. Its really unfair that they didn't treat us as a family and grant all the visas at the same time.

Hi Tina We were advised that if you sell your home in the same year you move to Spain and become a tax paying resident, you will be liable to pay capital gains tax in Spain of up to 23% on any money gained from the proceeds of your house sale in the UK. We sold ours last year looking to move this year.


Thats rubbish they have not processed them all together you would think it easier?


Not sure of the answer to this but Spain CAB are very knowledgeable and helpful


Was it straight forward to get autonomo visa ?

We've been told we need to submit business plans and have contacts and proof their is a need for the type of self employed business we are looking to provide. What line of work are you in can i please ask ?

@vellison Hi Victoria,

Thank you for your reply. I dont think you have to pay capital gains tax if the house is your main residence.

I teach private piano lessons and this is what i hope to do in Spain.

We have to fly to Spain next week as my work visa runs out 28th March.

We have to rent an apartment for 3 months to get the Empadronamiento and then I have to register autonomo and get the digital certificate (which I did whilst I was in Spain in February)

Then we can all get our TIE.

It seems really unfair to make you pay for an apartment that we won't use and to pay autonomo when I won't be working in Spain, until we sell our house and finally move out there in July.


What line of business are you in?


It is really hard to do this process, and my husband and I nearly gave up today, but we thought about all the money we have spent and we are going to continue.

You've been approved by the Embassy, so, really, you've done the hard part! It would be a pity to give up now.


Stuff like TIE and padron certificate are just administrative details. Sure, it would be easier without them, but they are not difficult (even if you do them on your own). With a bit of help from a local Gestor they should be no problem at all.

For tax declaration, the agencia tributaria will do it all for you for free, no need for a gestor, just make an appointment online starting on May 25th, just as a FYI…

My research on selling your home indicates that as long as you are not in Spain more than 6 months (183 days to be exact) in the year that you sell your home, you won't pay capital gains.  So, for example, if you sell your home in May of this year but don't move to Spain until after July 1, you won't pay capital gains.  One caveat to this is that any time you spend in Spain during that year counts toward those 183 days even if you were there for just a few days to visit.
