I plan to invest and live in Sri Lanka, I really love this beautiful country, and it's good people. I want to invest in a guest house in Mirissa.

Hello Elam, I am an Australia and my wife is a Srilankan national. We built a guesthouse in Unawatuna and it is the worst thing that we have ever done and it can happen to anyone at anytime.

    Once you invest, whether you buy a property or lease, all it takes is for someone to make a case against you weather true or not but if they can get the case into court you are going to spend many years dealing with lawyers and the courts. Please don't believe me, just ask anyone how long it takes to get an outcome over anything to do with land, they will tell you that it can take 10 to 20 years sometimes longer, so you have a choice you can stay and fight for your rights or go back home having to lose what you have invested. We are fighting and so far it's been going on for just over 9 years now. We have enough evidence to win this case but as it was caused by the defendants finding a lawyer who is apparently an acting Judge to forge my wife's signature on a deed of gift which has been analised by the Government Analytical Dept as fraud and the police have done their best to protect this so called lawyer to the extent that instead of making him a defendant they have made him a witness in this case, even though he committed the crime. Now at last the Supreme Court and the Human Rights Commission are investigating this case but pior to this I have sent the evidence to Galle CIB, CIABOC the CIABOC had our evidence for over a year and they stated that they sent it to the Inspector General of police, BAR ASSOCIATION, COLOMBO CID these departments as yet have not taken any action or even questioned us. We contacted the CITIZENS FOR TRUTH & JUSTICE and thankfully they are helping us.

   Until the Government decide to take corruption seriously and because this lawyer has shown that instead of following Srilankan law has completely disregarded it he should not be allowed to practice in this country or if it is felt that we have created false evidence they should of at least questioned us about it which have not yet done.

    My advice is that as thing stand it's not worth the risk to invest here.

  Seeing we have similar problem I tied to contact this doctor, but it appears that he passed away in 2021,he was an extremely well respected gentleman who did not een live long enough to see this case through. How many times has this said lawyer broken the law over the 21 year period.


The Supreme Court today ordered to remove a lawyer from the position of the Attorney-at-Law after he was found guilty of professional misconduct.


Dr. Lakshman Lucian de Silva Weerasena a Medical Practitioner by profession had complained to the Registrar of the Supreme Court by way of an affidavit against Attorney-at-Law namely Jayantha Attanayake and his wife regarding a series of transactions, that had taken place between 05.10.1992 and 01.08.1996 with regard to a property situated Lauries Road, Colombo 04.


The Supreme Court issued a rule ordering the respondent lawyer’s name to be struck off the Roll of Attorney-at-Law. 


“There is no doubt that the conduct of the respondent has brought the legal profession into disrepute and it is plainly dishonourable, disgraceful, and unworthy of an Attorney-at-Law. Hence it is clear that the respondent has also breached Rules 60 and 61 of the Supreme Court (Conduct and Etiquette for Attorney-at-Law) Rules 1988”, the Supreme Court held.


Supreme Court three-judge-bench comprised Justices Vijith Malalgoda, Murdu Fernando and S. Thurairaja.


The inquiry into the complaint was commenced before the Supreme Court after issuing the rule for the alleged misconducts against both Attorneys at Law. However, the second respondent, the wife of Jayantha Attanayake had passed away during the pendency of the proceedings.


It was alleged that two respondents had fraudulently attested five deeds with the intention of depriving the lawful heirs of the Estate of the late Agnes Georgiana Fonseka, the owner of the property who died intestate.


It was alleged that the first respondent had committed malpractice within the ambit of section 42 (2) of the Judicature Act No 2 of 1978 which renders, unfit to remain as Attorney at Law.(Lakmal Sooriyagoda)

This is a noble profession and it's really better and best to remove who alleged of misconduct of being Attorney -at-Law.it's for the betterment of the future of this profession as well as the sole nature of our country.

To be honest, the entire Bar should be disbarred for the misconduct in various ways. What about the judiciary.....?????

@Ranjohn22  Hi John,


I understand your pain and i think that I have seen your hotel in unawatuna with a sign outside saying "talk to me before you buy a property". ...something like that anyway.  Like in any country there are issues, however if you hire/work/surround yourself with the right people you reduce your exposure to problems.  It sounds from what you have written that you have not yet met the right people to do business with.  You have been unlucky and you may not have a very good judge of character.  I have been successfully running businesses in Sri Lanka for over 20 years, there have been issues in the same way as there are back in the west or in other countries where the rule of law is more advance, but on the whole my experience has been outstanding and very lucrative.  Like in every country, it all boils down to having the best reliable network of individuals that will help you find you way.  So my final advice to anyone thinking of making a property or business in Sri Lanka is to make sure that you are dealing with reputable people and companies - in the same way you would in any other country  - i think that is simple common sense.

That's good advice Ivan but when a senior lawyer /acting Judge breaks the law and the police back him up as well as an officer in the Dept of Lands swap over a deed it makes it extremely difficult to work around that. Thankfully we have a team of lawyers from outside of our district who can see what has happened and are in the process of writing this wrong. It remains to be seen how serious the powers at be are at controlling corruption.

Hi John,

Like in every country there are crooks.  This is such a small island that the crooks find us easily and foreigners can be easy prey, hence being very careful who you do business with from the outset.  Also, the crooks all work hand in hand like anywhere, but the difference is that Sri Lanka is a village... good luck and i hope to cross your path one day!
