Son born in Philippines. Birth abroad

My Question is..  is my son entitled to a social security benefit.  Being born abroad.  I am a American living in the Philippines permanently as well. Also, I'm  59 1/2 years old.  Thank you with any information.

i think you need to be collecting either disability or collecting you retirement benefit. The Social Security website has some information on this

If you have not already your son needs to apply for American citizenship at the US Embassy where upon approved he will receive a US Birth Certificate and a SS #.

Once he has these he is like every other American child born in USA and entitled to everything they are...

@Dwsses12, For Americans born after 1960, the full retirement age (FRA) is 67. You just need to be prepared for the hit in your monthly benefit pay if you do an early retirement at 62. Your pay will be 70% of normal and your spouse (if you have one that is qualified) could only be able to receive 32.5% of your pay.


Regarding payments for your son:


  1. Calculate your full retirement (at age 67 for you).
  2. Your son can receive up to half of your full retirement benefits (in some cases, this can be from 150% to 180% of the parent’s full benefit amount), after your early retirement at age 62.
  3. You must complete the CRBA where you are able to get both his US Passport and SSN first (Consular Report of Birth Abroad (CRBA), FS-240).: https://ph.usembassy.gov/us-citizenship/


Since your Medicare options start at age 65, you want to pay close attention to the the part B selection option, as even when it cost, doing it after the first eligibility period elapses, there are penalties.


In my case, I visited my local SSA office in Southern California late in 2022 and had my file reviewed for my FRA accounting summary. This way, I was able to get SSA to tell me exactly how much my new baby daughter's benefits will be, before she was born early here in 2023.


Example: A person's FRA benefits are $2000/month and they retire at 62 but have full retirement age of 67, they will receive 70% of the FRA or $1400 but their child will receive 50% of the $2000 FRA benefit. The total with the baby will be $1400 + $1000 or $2400/month. Where does the 180% come in? When the retired person has more than 1 child, the total pay-out can't exceed 180% of FRA benefits (example; 180% of $2000 = $3600). No matter how many babies a retired person may have, the max monthly would not exceed the $3600, in this example above.


Remember, SSA does not reduce the parent’s benefit amount to pay for the baby because the parent's benefit is never paid out as part of the maximum allowable amount from the start.


The process can be smoother if you have kept a US Bank account where SSA can and will direct deposit. As others have already posted, this info can be gleaned/confirmed from the SSA.

@Calif-Native Thank you very much.  I am retired here in the Philippines permanently.  I do have my American bank account.  And my son birth abroad has been done. I will just have to wait till I'm 62. But, i am filing for social security disability.  I am 100% permanently disabled by the military.  (VA).

@mugteck ..... Being born abroad does not disqualify an American for Presidency! 


Some use Sen. John McCain as an example of a person qualified to run for the Presidency but not born in the USA.  This is not a good example because although his dad was a Navy Officer and was stationed in Panama where he was born at Coco Solo US Naval Submarine Base and Air Station in the Panama Canal Zone; as this was a sovereign U.S. territory at the time of McCain's birth.


Simply put, the Consular Report of Birth Abroad is a document that certifies a child acquired U.S. citizenship at birth as a natural-born person.  Therefore, all persons with U.S. citizenship qualifications at birth are natural-born. 


The President "must be a natural-born citizen of the United States, at least 35 years old, and have been a resident of the United States of America for at least 14 years."


This gets into the "Birthright citizenship in the United States" and has been adjusted or clarified over time by the 14th Amendment.

Ahhhhh, thanks for more details.  The VA compensation for your son will start as soon as you submit the VA form (Application Request to Add and/or Remove Dependents (VA Form 21-686c) thru ebenefits/va.gov.  If you are 100% based on scheduler, you can visit those table to get the monthly added amount.  If you are SMC, just look up those tables.


Some vets are not aware of the SMC benefits.  There are different levels of SMC (Special Monthly Compensation). The  basic levels, range from (k) to (s) that form the foundation on what additional pay the vet will receive.  The higher levels range from (l) to (o).  When the vet adds a dependent, it also recalculates any SMC increases.


This is slightly off-topic but may serve as a guide:  If you are not sure about receiving SMC, just go to ebenefits and look under My Benefits & Payments, then click on Benefits:  If you see a window that lists "Special Monthly Compensation Benefits" with a + sign to the left, it means you are beyond scheduler and have SMC.  Click on the + and any SMC you are getting will be listed with it's code and Effective Date. 


Example:  The SMC-K code is for vets that have a “Loss of Use of a Creative Organ.”  I have assisted a vet that had 3 tours of VN/Agent Orange exposure and survived Prostate Cancer, but was left with ED.  Some vets may have an ED claim for secondary service connection, especially secondary to mental health conditions such as PTSD, Depression, and Anxiety. 


In 2022 vets SMC-K resulted in an additional $118.33 per month added to their total monthly VA disability compensation payment.

@Calif-Native again Thank you sir.  My 100% permanently disability is with ptsd. Anxiety and depression plus other disabilities.

Dwsses12, Although Housebound status is the main criteria that applies to SMC-S. If not already granted, you should look into SMC-S which is available to veterans who:


Have a 100 percent rating and an additional disability rated at or combining to 60 percent or more, or

who are substantially confined to his or her dwelling or immediate premises as a result of a service-connected disability.


You should not have to file VA Form 21-686c to get SMC but call/email VARO Manila to remind them of this automatic process (if you are not on SMC already). You will get additional pay for your son even if you are or are not married.
