renewal of the RNM

Hello everyone, my name is Alexandre I am from France and have arrived in Brazil a year ago to follow my girlfriend who has roots in there. I do not know yet how this forum works so excuse me in advance if I am not doing well posting here. I am  living in Goiânia, if someone has questions about the city feel free to ask. The thing is that I am currently experiencing a little problem in my capacity to stay in the country at the moment.


Indeed, I arrived with a Working holiday visa in May 2022. Then as the procedure demands it I got a RNM, valid until this summer. My goal is to stay here, but I feel like I am in the middle of the requirements of the two visa I can expect to be accepted. I am working for an European investment fund that have interests in Brazil. As such I am getting paid in BRL, but as an independent worker in my MicroEmpresa. So I cant really demand for a working visa because I am not working for a brazilian company (even if the company that pays me is Brazilian, but have no employees, this is directly the pool for investments). And I cant ask for a Digital Nomad visa too because I do not have a contract as I am an independent, and the structure that pays me, again, is Brazilian.


I am a bit lost on what to do, and a bit surprised to face such problems considering the fact that I have bank accounts here, a microempresa and a health insurance: meaning I am already integrated to the Brazilian society; but I face the risk of being excluded soon. Do you guys know means to get maybe a renewal of the RNM without using visa ? Or maybe a little direction on what I could do/who I should ask ?

Yes, we usually just have introductions here and respond to questions in other threads, but no problem.  I'll respond to your question in a thread that I'll call "Staying on in Brazil at the end of a Working Holiday Visa", so look for that thread later today.

Good morning, Alexandre. Assuming that your girlfriend is a Brazilian citizen, the easiest and fastest way for you to become a resident would be for you two to either marry or declare a União Estável. Since you don't mention this, I assume that there's an impediment. If not, I can expand on the topic in response.


The Working Holiday Visa is very specialized and only available to citizens of a few countries. It's not intended for extension, or to be leveraged into a more permanent situation. So you almost certainly do need to change the basis of your residency to stay.


You may be able to change the status of your Authorization for Residency to "Trabalho". The current Lei de Migração (http://www.planalto.gov.br/ccivil_03/_a … l13445.htm ) foresees the possibility of living in Brazil on this basis without an employment connection -- "sem vínculo empregatício no Brasil" -- as long as the work is formalized by a legal entity functioning in Brazil, which may include your situation. And even this last requirement may be waived if you have a university degree or equivalent. (Subsection IV, Article 14 (III), para. 5)


This exception is rarely used. You should consult a labor attorney before your current Authorization for Residency expires to determine whether you can take advantage of it.

I doubt that you'll be able to renew your CRNM.  The Work/Vacation visa is highly specialized.  I'm not an expert in it, but I doubt that it or any Authorization for Residency connected with it are renewable.


Before you go back to your home country, I definitely think it would be worthwhile to talk to a Brazilian attorney, and bring the legal citation I provided above to his/her attention.  Some of these people are able to work wonders with the Federal Police.


Yes, if you leave Brazil and return, you should be entitled to the usual allowance for French citizens of ninety days, with the possibility of renewing for another 90 days for a total of 180 days in each rolling 365 day period.  Each time you change visas the count of your time changes, and the days that you have been here under your Work/Vacation visa would not ordinarily count against your future tourist visa.
