Employee Transfer - Local Transfer

Hi ... I need some advised, maybe some of you already encountered this matter.

My contract will end this coming October 2023, and my Iqama will expire on December 4, 2023.

I don't want to renew my contract with them and planning to transfer to new employer once my contract expires.


However, my preferred employer doesn't have Agency in my origin country, and they are recommending having a local transfer through Qiwa after my contract expires.

My question is, will there be a problem with my current employer if I sent them that I will not renew my contract with them after my contract expires and will request to have a local transfer?

Do they have the right to reject the transfer? (if ever that time will come and they reject it)

johnryl1ubuntu, one of the first things you need to do is to understand the local culture especially that which governs employer and employee.



I suggest the following approach:



    Ask your current employer if they are going to renew your contract. If they say "NO", ask if you can transfer your Iqama, and keep it humble. If they say "YES", then you must resign, requesting a cost to transfer your Iqama to another Sponsor.

    Determine from your existing contract whether your employer agreed to a 'transferable Iqama'

    Determine the Saudinization of the two employers, current and preferred, are they Green, Yellow, Red, or Black? If your existing employer has a RED or BLACK rating, you may be able to transfer without their permission.



Look at Step 1 and 2 and determine your action plan.



KSA Labour relations are changing by the month as the HRSD gets into HIGH GEAR to meet KSA's 2030 Vision. and while the decision is not always the Employers. Currently, the Employer, especially if they brought you into the country may have a certain right to recover costs, speak to a lawyer regarding this. However, if you keep it professional and understand the current employer's perspective and look for a win-win approach, it is possible to get them to agree to a transferrable Iqama.
