Previously married, more than 10 years separated, not annulled

Hi,

good day to everyone!

I am up to this date by paper legally married but is more than 10 years separated from my ex husband. Is there any way that I can get married to a Muslim man without undergoing an annulment? (Considering the costs in Philippines and the time it takes for the whole process of annulment).

Will a conversion to Islam legally invalidate my previous marriage in Philippines? Will I be able to get a legal document for that?

I hope someone can enlighten me with my query!

Hello MM and welcome to the forum.


I would say nothing short of an annulment would allow you to remarry in the Philippines. If simply converting to Islam invalidated a marriage I think there would be many conversions for that reason.


You may be able to divorce your husband in another country. I dated a Filipina in the US who had a husband in the Philippines. She retained a lawyer and divorced her Filipino husband and that allowed her to remarry in the US, but I don't think that divorce or marriage would be recognized in the Philippines.

Hi MM, welcome also. What Moon Dog says makes some sense but perhaps spend some Pesos and consult an attorney versed in annulments and get a professional opinion.

OMO but I doubt very much swapping religions would do away with your marriage in the Philippines, is your current husband Pinoy and have you spoken to him with regards to this issue? Remember that he is still your husband legally here.

Your bio says you're currently living in Germany and would like to move to the Philippines.


(1) Did the marriage take place in Germany or in the Philippines or someplace else?

(2) Are one of you or both of you Filipinos?

(3) Question 1 &2 will determine what path you should take.


(4) While living in Pittsburgh, PA  I was able to get a no fault divorce. Being separated for three years qualified me.

(5) Then living in Las Vegas, NV, I often saw advertisements for $199 divorces.

@Moon Dog hi… thank you for the response. Unfortunately, the country which I am currently in does not allow filing a divorce to a partner who’s not their national…

Your overseas divorce must be introduced into the Philippine legal system where you end up residing and then a judge would have the power to recognize your divorce.
