Hi fellow expats, my last day of working with my current organization is 20th October (I joined in January this year and EP expiry is in 2024) and I need to get information about Tax Clearance and EP cancelation process.

Whether EP cancelation and Tax Clearance are interrelated? e.g. EP cancelation can't be processed without Tax Clearance.

How much time it takes to get Tax Clearance certificate and EP cancelation?

I am planning to book return ticket on immediately after (because of medical emergency in family) my last working day but my current organization says they can release full and final payment on 7th November. Do you think that will be ideal or I should not leave without getting my full and final?

Do you have any information regarding documents required in immigration while existing Malaysia for good?

Is there anything I should take care of before leaving Malaysia?

Thanks in advance.

@rupkzope I am still waiting for my Tax Clearance as of today. I submitted the documents to the Tax Office last Aug 16, they said it will take 14 business days, but that's not the case. For my previous company, I will submit to them the tax clearance letter before they can proceed with the EP cancelation. Don't have an idea yet as to how long will the EP cancellation take as well, but as far as I know you cannot exit the country without clearing your tax. So best consult with a nearby office first. Check also if you have a tax refund money. You can raise your need to exit the country immediately due to emergency.. maybe they can arrange something.

@rupkzope Hi. There is no problem if you haven’t got your Tax Clearance Certificate if your company needs to cancel your EP. I got my tax clearance certificate after two months (I’m in my home country already and HASIL provide it via email/softcopy). Just make sure to provide all the necessary documents to Hasil for the Tax Clearance. After that, they will give a piece of paper stating that you completed the documents required for Tax Clearance and your certificate will be provided 14 working days. But that didn’t happened on my end. Haha. It took them 2 months to provide.

If you walk in to their office, they will give you a list of the documents that you need to provide because we all have different cases. I suggest for you to start compiling the documents. The earlier the better.

EP Cancellation on my end is quite fast, my company just took 1 week to have it cancelled in Immigration. Just make sure that your company agrees on your flight date going back home. In my case, my company want to cancel my visa just until my last working day and that’s a rush for me to pack my things. So I begged to cancel my visa on the flight date that I book which is 3 weeks after my last working day.

For your last pay, you need to ask this to your company. On my end, I received mine after a month through my Maybank Account and I’m already in my home country.

That’s it. You just need to do EP cancellation (which your HR will do for you) and Tax Clearance. But if you want to make sure, you may ask the HASIL staff if you will visit their office if what other stuff that you need to settle before leaving MY.

Best of luck.

Thank you for your response. I really appreciate it.

One more confusion whether I can exit without Tax clearance certificate or not?

I am wondering @AnnVera did you produce any document while exiting country? Like payslip showing your organisation used to debit tax before crediting your salary.

AnnVera

@rupkzope Like on the immigration officer in Malaysia upon exiting the country?

Nothing. They will just look at your passport and mainly your EP. Let me know if this not answers your question.

rupkzope

Yes I wanted to check that only @AnnVera. Thank you for clarifying.

So basically while existing country I should make sure that EP cancellation is done or not, without worrying about Tax Clearance letter as immigration officers don’t ask for it while exiting country after EP cancellation.

AnnVera

@rupkzope Yes that’s correct. Immigration officers will just look at your passport and your EP. That time, the immigration officer just asked me if my contract is already finished because my EP is cancelled, and I said yes.

That’s it. Then he just stamp my passport.

Don’t worry about the Tax Clearance Certificate/Letter. They will not ask for it.

That will take a while to be released by Hasil.

Upon completing the Tax Clearance on their office, they will give you a letter/a piece of paper stating that you completed the documents, keep that just in case.

Let us know in this thread how it goes once you exit Malaysia. Best of luck! Don’t hesitate to ask if you need more clarification.

Hi fellow expats, thank you for your feedbacks on my queries. I am writing this post to update my exit process from Malaysia.Firstly my EP was cancelled within 5 days by my employer upon confirming my date of leaving Malaysia. This was done 3 weeks in advance. EP cancellation and Tax clearance are not interdependent so both processes can run in parallel. While exiting KL, immigration officers did not ask anything related to Tax clearance and only checked their records against my EP.Tax clearance was a lengthy process and even after LHDN officer ensured me that I will get feedback within 14 working days it took almost 2 months. I submitted my documents (prepared by my HR) to LHDN office on 18th September 2023 and got Tax Clearance on 14th November 2023. This whole time waiting I just checked status on https://mytax.hasil.gov.my/ in SPC section and didn't follow up with LHDN of my HR. Most important thing to get Tax Clearance hassle free you need to make sure documentation and required copies are correct. You can find document list here, provided at LHDN office.Thank you for your feedback and support!

Hi, I find this forum very interesting. I just have few questions regarding EP cancellation and Tax Clearance.

I have been working here in Malaysia for 4 years now and this is my first time to change employer. My new employer said that I don’t need to leave the country so long as I can provide all the necessary documents specially release letter and tax clearance. I have given them a release letter but I’m still waiting for Tax clearance because my current employer is following dates from Hasil.

Now, my problem is my current visa will end on January and my starting date on my new job will be on end of February. From Feb 1-27 I don’t have a valid visa. What can I ask for my current and new employer to help me sorting this while waiting for my Tax Clearance?
