Spousal Residency Permit for EU Nationals & Portuguese Citizens

Post new topic

canadaportugalvisa22

Hello,

For the spouse of an EU National or Portuguese citizen to reside in Portugal I found this information - https://www.sef.pt/en/pages/conteudo-de … ID=22#div2

Does the 'registration certificate' allow the spouse to work once received?

Also, if the applicant is a Portuguese citizen spouse, does the marriage need to have been already registered in Portugal to receive the residence card? Or is that only if/when they decide to apply for citizenship?

JohnnyPT

Yes, of course. The marriage must be proven, possibly with certified translations from the Portuguese consulate in the country where you live.

Your spouse is an EU citizen or not? The procedures are different.

Hi Johnny,

I meant does the marriage need to be registered in the Portuguese system before applying but seems it’s not the case as long as you have your translations and proper notarization ready to go with your application.

Spouse is non-EU (England) with marriage in England.

Seems fairly straightforward either way.

Just to confirm, they can legally work with this residence permit, correct?

So the section of the link isn't the one you're referring to, it's this one.

- Original marriage must be certified with apostille

- the spouse can legally work with this residence permit but must apply for the NISS number to work

Johnny, this link is for registering the marriage in Portugal through the Consulate’s mail application system. Are you meaning to say this would need to be done prior to applying for the residence permit in Portugal?

JohnnyPT

Check this with the PT consulate. All the links say is that you need a marriage certificate, without any further information. It probably doesn't need to be translated because it's in english, but as it was made outside the EU, so it needs to have an apostille.
