Expat Emergency while outside belgium

lucasrfduarte

Hello all,

I'm living in belgium with a work visa ( type D) and recently I came back to my home country (brazil) cause my grandfather is facing cancer and my family needed a bit of help with the chores, so I took the oportunity to see them on christmas and New year too. I had the unfortunate news that I also do have cancer and had an emergency surgery and now I'll need to undergo chemo. Since it is an agressive treatment I'd like to have my sessions here in Brazil with my family, but then I might return a bit after the 3 month that I'm allowed to stay outside belgium without warning my comune.

Is there something I can do to not have issues with the visa ? Should I contact the immigration office or I have no other option than going back to belgium and face the treatment all by myself ?

Thank you very much for the help folks

You are fine mate ..take care of your health rest doesnt matter

you are allowed to stay outside for more than 3 months upto 6 months

only after 6 months it becomes  an issue that too because your tax residence status

if you have a residence permit  card you are really ok

worse case if you are non registred as a resident here it wont anyway matter

good wishes and speedy recovery

Hello all,

I have a similar question.

I'm living in Belgium with a work visa ( type D) and my husband came to Belgium also with family reunion, he is not working. He is outside of Belgium for family issues, his total stay of time out of Belgium is now almost 3 months in a year. And he might need to stay 1-2 months more. But not aim to exceed 6 months.

Does my husband also allowed to stay outside for more than 3 months up to 6 months? I talked with the commune in Brussels and they said normally it is 3 months max in a year, nothing to extend it (any medical proof etc), and then resident permit can be cancelled if police finds out. Do you know if airport police control checks the passport and count days or they have anything in system? I also read some comments in the forum that some returned back after 4 months and nothing happened with their resident permit.

Thank you so much for the help in advance
