Buying land Diani Beach area

We are looking to buy residential land in Diani Beach area to build a family home.

We know there can be land advertised that is a scam  so have been looking via property agents.

A couple of questions if anyone can help with

Should we use a UK solicitor to carry out searches and purchase ?

Do we have to apply for permission to build and register this?

I would advise as follows:

  1. Land Titles are key to understand and verify locally in Kenya. There is a clear process in Kwale (for the region) and due diligence is vital.
  2. There is an excellent company called Sandlovers based in Diani and they specialise in real estate sales, land sales etc and have great local experience
  3. Whatever you do have a well reputed local lawyer/adviser

and yes you do need local permissions to build and non-Kenyans are not allowed to own freehold. Be sure also to understand the visa side of things if non Kenyan passport holder

As Such,Regarding Searches and Purchases, it is recommended by Law that You Get Assisted by Kenya's Land Registry to clarify the Legitimacy of the land and Avoid Scams...as such, Your solicitor can work with the *** and Go through the entire land Registry first on viewing, then head on to Purchasing.

Is it wise to find a local solicitor or find one in the UK that understands Kenya land purchasing.

as someone has advised you,you cannot own a land in freehold. You will be able to get a 99 years lease upon purchase. I don't think that a UK solicitor would be of any helps he/she would have to liaise with a local one. The best solution is to find a reliable local one (can be tricky) The fact that you own a land and a house in Kenya doesn't give you any right to a specific visa. You will have to go with the 3 months tourist visa with 2 months extension. Then you will be able to start the process of obtaining a resident visa, “K" class that will cost you 100,000 Ksh/year.
