Flemish training leave

Hello,

I have a question regarding the training leave particularly those that have done it in the Flemish region.

Does the it affect your salary if you are working in the private sector? My understanding is that it doesn't and that the government reimburse the company for the leave days you take. This does not however affect your monthly salary from the company.

Does the company have a right to suggest you take lesser days than you are entitled to?

Thanks in advance.

Cheryl

Hi Ewms,

1.For the salary:

It does affect your monthly salary if you earn more than the government reimbursement.

Now the salary limit is 3500 euros gross per month. Above this amount, you won't get the reimbursement.

However,  it is more complicate than it. It takes your monthly gross salary and also weekly working hours into considerations because you normally won't take a whole month leave.

If you earn 4000 gross per month and work 38 hours per work, your hourly wage is 24.29

but you can get max 21.25 per Flemish training leave hour:

  1. The limit is gross per month x 12 months  =annual salary : 3500 * 12 = 42.000
  2. Annual salary divide by total weeks of the year and than divide by your weekly working hours* = Your maximal hourly wage when you take Flemish training leave :     42000/52/38* = 21.25

You can check the website (it is in Dutch) below, it gives good examples:

2.Days of leave

You can always request to take Flemish training leave, and use all the hour you are entitled to have. If they want to reject it, they CAN but need a very good reason such as there are more certain %* employees will have taken leave on that day. It is very difficult to reject your request to be honest. Even though they can, it will be only for a certain dates, you can always request to take the day-off on another day (unless you work very small company.)

*That is a very clear guideline for companies but I couldn't find it.

I hope it helps :)
