Property rental lawyers in Bergamo

My first rental in Italy hasn't gone terribly well. The landlady cited no fault with the apartment, which was returned in the same condition as let, however she has not repaid the security deposit nor the credit for the spese condominiale and has stopped communicating after 3 months.


The WhatsApp conversation with her should provide all the information needed to win a court case, which, sadly, it seems I will need to pursue.


Can anyone recommend any good lawyers in Bergmo specialising in this kind of thing?

Have a word with your Embassy they normally have a list they can give you.

Presumably you had a registered contract at the tax office?

The tenancy was, to the best of my knowledge, registered with the Comune - I recall the agent asking for our Codice Fiscale for this purpose.

OK - Unless you had a rental contract registered at the Tax Office, and you paid for it, you dont exist.  It was illegal to rent to you and it was illegal for you to rent.  You cannot prove you ever lived there or paid rent.  Presumably your landlady knows that you dont have a leg to stand on.   No rental agreement is ever registered at the comune.  It was I assume for more than 30 days?   If there is an agent your first call is tehre - they must keep the paperwork and they have a legal responsibilty to protect their clients.   But again if there is no contract, you never existed according to law.

It was registed by the agent with some office. We had to provide our Codice Fiscales for the contract to be registered. The agent originally got one of those wrong, the registration failed, and had to ask again.


Back to the question. I've now contacted half a dozen lawyers. Not a single one can be bothered to respond.


This should be a really straightforward matter. The landlord has raised no objections, not sought to claim for anything, and has simply decided to keep all the money.


I'm tempted to go around there and just keep ringing the cittifono all day but I don't know if Italy has harrassment laws and, if it does, if anyone bothers to police and enforce them.

Id go to the agency.  It is also their problem.  They rented you the place and have a responsibility to both parties.  If they huff and puff,  tell them you're going to go to the Guardia di Finanza - youd be amazed at the effect that can gave.
