New Residency Policy for Graduates of Brazilian Higher Education

09/09/24  A new Resolution CNIG/MJSP No. 50 from the Ministry of Justice and the National Immigration Council published in the Diário Oficial on September 5 liberalizes the conditions for foreign graduates of Brazilian faculties and universities accredited by the Ministry of Education to remain in Brazil as residents after graduation. 


Sponsorship by a Brazilian employer with the Ministry of Labor will no longer be required.  A graduate will only need to present these documents to the Polícia Federal to qualify for residency:


I - Application for Residence Permit, signed by the applicant or his/her legal representative, as per Annex I of this Resolution;


II - Valid travel document or other document proving the identity and nationality of the applicant, in accordance with international treaties to which the country is a party;


III - If the identification document does not indicate filiation data, the applicant must present one of the following documents:

a) birth certificate;

b) marriage certificate; or

c) consular registration;


IV - Indication or copy of the Individual Taxpayer Registry - CPF;


V - Diploma or Declaration of undergraduate or graduate studies stricto sensu and academic transcript from a Brazilian educational institution accredited by the Ministry of Education;


VI - Certificate of criminal record or equivalent document issued by the competent judicial authority where the applicant has resided in the last five years;


VII - Declaration, under penalty of law, of absence of criminal record in any country, in the last five years prior to the date of the application for the residence permit;


VIII - Employment contract or proof of provision of services;


IX - Contract or articles of association of the contracting company;


X - Deed of election or appointment of the legal representative of the company, duly registered with the competent body;


XI - Power of attorney when the applicant is represented by an attorney; and


XII - Simple Federal Collection Guide - GRU, for the processing and evaluation fee for applications for residence permits with the respective proof of payment.


§1 The activities of the position provided for in the employment contract referred to in item VIII above must be connected to the applicant's academic curriculum.


§2 The initial term of residency will be for two years.

09/09/24  It's worth noting for graduates who qualify for residence under this Resolution No. 50 and who eventually want to become Brazilian citizens that the same successful graduation that provides grounds for their residence will also satisfy the language requirement for naturalization without any further tests or courses, once they complete the required continuous residence period.
