lawyer hired and paid 50,000 pesos upfront

it has been 1 yr has passed and the lawyer we hired to represent us in court has not done anything? He was specifically given an instruction to file a criminal case against illegal trespassing in our property but has done nothing unless we remind him to file our complaints in court. To this date we heard nothing or any court decision to our complaint.  Are we entitled to get a refund of what we paid him (totally or partially)? How long does it take for the court to make a decision after the complaint was filed? This person who illegally occupied our property  lied to his teeth claiming tenancy under Agrarian reform act? The thing is he was never a tenant or has shared any harvested product to us? He also signed a legal document stating that he is not a tenant and should vacate the property as soon as the owner demand him to do so, but instead he is now demanding that we paid him 300,000 ( for what)  pesos which we of course refused to even consider that is the reason why we hired this lawyer to expedite his eviction. What are our rights as owners and how do we deal with this person and this lawyer? Any help concerning this matter will be highly appreciated. Thank you very much

Welcome to the forum emushu, Can I ask? Are you yourself squatters or do you hold a legal title over the lot in question?

Have you had meetings with the local Barangay as they are the first port of call with matters like this and usually resolved amicably with no attorney's involved.


The mouth piece you paid P50K to, what has he done and where is your case now? We don't know the fine details and whether if it does get to court it will stand up,,,,,,, there are many variable here especially if you are a foreigner.

Hi, we got these cases here in Boracay. This is not handled by a lawyer but the local police. Those who got removed stayed on the street in front of their former lot, the owner made a fence and a security company guarded the lot until all the people have left.
