Can you tell me how easy to get a bad tenant,in Koh Samui and what to do if he refuses to leave

EASY!

Presuming he's an expat of sorts, go to the police station, ask for the big boss, give him 5,000Bht (for his children's education - VERY IMPORTANT). He'll take care of it! The tenant will pay for damages, and as much rent as they can get from him. It's amazing how people can find money very quickly when the police show up at your front door.


Most importantly, you have made yourself a fantastic contact for any future issues. Anything from being pulled over for nothing, being scammed in any way, problems with Thai people that may arise, or anything. He's there for you from then on, as long as you don't screw up yourself badly, then you're on you're own.


Get his correct name, and phone number, and you've got yourself an insurance policy. just look after, and always ask about his children and his family. I've had an incredible (family-style) genuine relationship with my 'big policeman' for 12-years. He's helped me maybe 8-10 times over that period. They will be friends/family for life.


Anyway, go meet your next best friend tiger, and enjoy the life and the people as you're supposed to!

You mean you have no contract that stipulates the events in which he is a bad tenant?

Then just go to a lawyer..

You can involve the police, but you make yourself corruptible for the rest of your life..

They will come back every New Year, Chinees New Year, Songkrahn, new school term, month end, the Kwai died....etc. etc.

Reading your text I would tend to say, that's extremely easy to get a bad tenants 1000 are on the waiting list LOL ... ..... but i believe you meant how easy is it to get a bad tenant out


Before giving advice it would be good if you could give some more information about your tenant and the conditions under which he his renting your house/apartment.


  1. Are you living long term in Thailand or mainly abroad? case management can be very different depending upon your availability in the country
  2. Are you the legal owner of the house/apartment with registered and up to date title deed?
  3. Do you have a written legal rental contract with him and what s the expiry date of it
  4. Is your tenant Thai or foreigner ? Difficulty could be different.....
  5. What is a bad tenant ? which condition(s) of the contract he is not respecting? Payment or other reasons or both?
  6. Did you already warn him officially by registered letter? What actions did you already take against your tenant in order to build up your file??
  7. What evidences do you have about his supposed unlawful behavior?


If your case is proven worth  and solid, it won t be difficult to get him out with the help of a lawyer. Just a question of time and costs ?


Involving the police can work under certain conditions ( i agree with what Martinoo2002 is saying , by personal experience) in small villages , surely not in a bigger size city where they have absolutely no right to be involved is such a dispute unless they get orders from justice. ( your possession being in Samui tells me its even not the right way too operate .......)
