You Are Deported!

Post new topic

Ok, so the "D" word can be scary, especially if you are living in another country. I happened to be watching 911 Lone Star where the character was in the USA legally but was about to be deported because he unintentially hit a police officer.

Even if you have Permanant Residency or Citizenship are their situations where you can be deported for certain actions?

Spoiler Alert: Everyone on the show got hit by an Asteroid, so I guess Deportation was not the big issue, however please let me know.😮

Certainly a permanent visa is a privilege, not a right, and can be taken off you for serious crime (but not minor stuff!).

Not for random bad acts.  Under the Law of Migration, a resident can lose his/her residency if the cause for originally granting the residency ceases to exist, if s/he is out of Brazil for two continuous years or more without a justification acceptable to the PF, or if the residency was obtained on the basis of fraud. (DECRETO Nº 9.199, DE 20 DE NOVEMBRO DE 2017).  In all of these cases, the resident has the opportunity to appeal.  If a resident foreigner is convicted of a sufficiently serious crime, the court can order his/her authorization of residency revoked once all appeals have been exhausted.

It's practically impossible to lose Brazilian Citizenship whether obtained through birth or naturalization without voluntarily giving it up.  A naturalization can be revoked if it was based on fraud, and there are a few other pretty extreme crimes that can result in revocation after final conviction.

I have noticed that most people who move from one country to another are for reasons other than to engage in criminal activities in a new country. That's why a clean criminal background check by Brazil is a smart requirement.

There is probably an extremely small percentage of people who are rich or powerful enough to falsify or circumvent those requirements. Deportation would be a welcome relief but it will take a really big effort to find and prove. I am grateful that there is a law on the books for those.

I think that illegals would most likely contribute to the criminal element - as they would most likely fail the legitimate route.

Typically not something to worry about for someone who has followed the legal route.

@roddiesho - Hollywood movies and movies in general tend to exaggerate or touch on sensitive issues - just to hype things up. Deportation in the US is definitely something that is on most minds nowadays....

@Pablo888 Yes, but honestly, I did not even think about it once I got my Brazilian Permanent Residency.  In the show the character only took action after he was attacked and did not know the person who did it was a police officer. Even in real life it is not unheard of for someone to push you at a soccer game or try to steal your phone. It would be nothing if you pulled away and that person was hurt. Even the best intentions can cause harm.

I am glad they did that episode, though having them ALL killed by an Asteroid, kinda kept me from knowing if he was actually deported.
