Renewal of retirement visa /background check

Kurterino

Unfortunately, my retirement visa will expire at the end of September this year (2025). Btw, completely unrelated to my question, it was valid for two years, even though on the application documents , it said that it was only gonna be valid for one year.

But now I’ll have to go through the process again, which should be relatively easy, except that I’m not sure about the criminal background check (probably not important, but I’m not from the US, but from Switzerland). I have been traveling quite a lot, and I’m not exactly sure how much time I spent in Brazil, but in 2024 and 25, I’ll have stayed more time in Brasil than in Switzerland . Hence my question:

Will I have to get a criminal background check from Switzerland, Brazil, or both countries? Obviously last time I had to get it in Switzerland (which is a very easy procedure), but now i have spent more time in Brazil than in Switzerland , so I’m just not sure. If it’s Brazil, how would I have to proceed? My address is in Salvador, Bahia, so could I get one from the PF here? If so, by filling out a form on the Internet or by going there personally ?

03/20/25 @Kurterino.  My reading of the Normative Resolution (https://portaldeimigracao.mj.gov.br/pt/nav-guiada/rn-40) is that you'll need both Brazilian and Swiss background checks.

You can get your Brazilian Federal background check online here:

https://www.cjf.jus.br/cjf/certidao-negativa

Assuming that you live in Bahia, you can get your state-level background check here:

https://www.tjba.jus.br/portal/certidoe … eiro-grau/

If you've registered an address in any other state with the PF during your residence, you can get your state background check on the site of the Tribunal de Justiça of that state.

@Kurterino For me, the way this worked was I got the Temporary Retirement Visa (it was good for 1 year).  As I understand it the function of the Visa is to enter Brasil to allow you to go the the PF and apply for the CRNM (which will be good for 2 years).  When the CRNM expires, you either renew for I believe 10 years, or if you are old enough, the renewal will be "indeterminado".

Is this what you are doing?  Renewal of the CRNM?

Unfortunately my Swiss background check isn’t clean anymore (It’s about narcotics) , but will be clean again in 5 years at most (AFAIK). Does anybody have any experience with this? My question at this point is if I should give it a try anyway, or if it’s smarter to wait a few years until it’s clean again? I’ll still be able to spend 6 months per year in Brazil , and  there are other places that I know well and like a lot where could spend the other 6 months, so it wouldn’t be a huge sacrifice

03/22/25 @Kurterino.  I'm very sorry to hear that.

Depending on the severity and disposition of your charge, it might be worthwhile for you to consult a Brazilian attorney well before your Authorization for Residency expires, to determine whether this clause of the Law of Migration, Section IV, Art. 3 may work in your favor:

"III - outras hipóteses definidas em regulamento.

§ 1º Não se concederá a autorização de residência a pessoa condenada criminalmente no Brasil ou no exterior por sentença transitada em julgado, desde que a conduta esteja tipificada na legislação penal brasileira, ressalvados os casos em que:

I - a conduta caracterize infração de menor potencial ofensivo;"

"III - other cases defined in regulations.

§ 1º A residence permit will not be granted to a person criminally convicted in Brazil or abroad by a final judgment, provided that the conduct is classified under Brazilian criminal law, except in cases where:

I - the conduct constitutes an offense of lesser potential harm;"

This law precedes the creation of the current Retirement Visa, and especially since you've already been granted an Authorization for Residency, there may be room for a renewal.

@abthree

Thanks a lot, that’s very helpful. I have come to like Brazil a lot and even bought a used scooter, so it might be worthwhile to give it a try. It’s a lot easier to be able to just travel back and forth without counting the days, plus I need to see an attorney anyway to do my taxes. I’ll just try to find a large office with different attorneys/specialties , that should be easy to find, given that I live just 30 minutes from Salvador
