Need Help For My Daughter

Hello all,
This is the first time i have ever written in a forum, so please be gentle with me.

I am an Australian living in Australia, who has a daughter in Indonesia through a holiday fling. The mum is no where to be found and Australia will not allow me to bring my daughter into the country.

I have citizenship in Malta via my mum as she was born there, i am thinking of moving to Europe if Malta will accept my daughter as a citizen. I am not quite sure where to begin as i went through the process a while ago and also moved house and finding documents will be a nightmare. Having said this i submitted all of the requied documents when i obtained my Maltese citizenship.

I would be very greatful for any advice that you belive would help me.

Hi and welcome to the forum.

These kind of cases can be very difficult.

The first and main question is: Who has legal custody of the child?

If you don't have it then you will need to get it !

Is the child an Indonesian citizen?

You should get legal advice in Indonesia as to how to have the child legally leave Indonesia.

As to aquiring citizenship of Malta through registration look at these regulations.

With the few details given it seems that your daughter is not entitled to Maltese citizenship but I could be wrong. Please check out terms and conditions.

If you are the legal guardian of the child, then under EU law, as you are an EU citizen, she can reside in the EU as a dependent of yours - thats my understanding. Now that doesn't mean your daughter will get citizenship, thats up to Malta, but she would have the right to live here as long as you are here, and shes a minor.

Thanks for the reply and for the link. Yes she is leagally reccognised as my daughter in Indonesia.

The sticking point is whether you have the legal guardianship over your daughter or the mother or somebody else.

That is a different question as to whether the child is recognized as your daughter.

As Indonesia is an Islamic state religion could also play a role.
