Hi there :)

This may seem an unusual question and some may prefer to reply privately, if reply at all.

We are in the process of negotiating our contract to long term rent the apartment here at Xaghra. This is being done very amicably and there are no major issues, indeed I am confident that there is no issue that cannot be resolved.
My questions are these:
Do any of you have contracts with 'break out' clauses?
We would like to include that in the event of either my death or any serious medical issue to either of us, either of us could terminate the contract?

Does anyone know where I may find any contract templates applicable to Malta?

Is there any such thing as a 'usual' contract? (I imagine not :))

i have come across contracts before which do allow you to leave the contract early in cases of family emergency health issues etc but id say theyre not usual/normal - i would also say that if you have got a good landlord they would understand and especially if you have a good relationship with them. at worst you would lose your deposit....

He got a "standard contract" (letting agreement) from the agency, which we modified acc. our needs (long let agreement) so that it looked much different afterwards (yes, that's possible if the landlord agrees) :)

First the respective paragraph said:
"In the event that the Tenant is compelled by 'force majeur' to leave the island prior to the termination of the Lease, then provided that the Tenant gives one month’s notice to the Landlord, the Lease shall be terminated at the end of the said month. The deposit equivalent to one month’s rent paid at the start of the lease will be forfeited by the Tenant and will pass to the Landlord in lieu of the rent that would have been paid during the one-month notice."

We changed this to a more general wording and cancelled the "deposit"-clause:
"Should the Tenant be compelled to terminate this agreement by some unforeseen circumstance prior to the lapse of lease, then provided Tenant gives Landlord one (1) month’s notice in writing, hence this lease shall be terminated at the end of the said month."

Anyone knows if the tenant can break any standard home rental agreement by paying some specific compensation to the landlord? If so, how is calculated the compensation to be paid?

i have over the years broken two contracts both for twelve months and left after 6months in each case and just lost my deposit of one month rent....
