Non-EU spouse EU citizen need help??!!

Hello,

Am moving with my husband from Italy, we need to start the process to take a temp resident but we don't know the procedure in Malta, here my situation,

Am Italian citizen work as freelancer for newspaper, am married with non-eu, he got resident in Italy, we read about free movement law and is the best for us to apply to self sufficient category, I have house in itlay and the avg. what i earn in italy around 22000 euro per year. what I need to know what is the steps to do for me and my husband.

PS: we are planning to rent house for long term, which is a good area served in public bus and shops with rent around 350euro 1bedroom or 2bedroom?

Hi - there is no such thing as temporary residence (other than for students), just tourist and residence :-)

As you are EU citizen, as long as you have sufficient income or capital and healthcover, then you have a right to live here. Your husband has a right to live here with you as a dependent of you (family member).

will you still be working in Italy ?
are you intending on proving self sufficiency through showing sufficient income or sufficient capital ?

what you need to do is apply for eResidence document - this is a new document that acts as both a residence document and ID

Hi hafteem,

welcome to the forum.

You will be applying for ordinary residency not temporary residency but not until you are actually in Malta.

Your income is enough to apply as economically self-sufficient but you will need private health insurance coverage for both of you to apply. Later you could switch to paying your own contributions to the national insurance when you have a tax number and have registered yourself with ETC.

When you become a resident of Malta you are supposed to give up your residency in Italy by informing the authorities that you have left Italy.

350€ is the lower end of the price for 1 or 2 bedrooms but you should be able to find something if you stay away from the Sliema/St.Julians area.

Take a look at the new id card thread to get a feeling for the 'new' procedure to apply for e-residency. Your husband probably has a card issued by Italy.

Thank you for your reply, as I explained I will continue work for Italian newspapers as freelancer in any place including Malta, however, I have monthly income from Italy,I can't move my resident to Malta as well my incoming tax for many reasons,I can show that I have saving amount in bank as well as bank statement from my Italian bank,Gov. tax declaration and my real-estate ownership cert.

Is that enough form them??

You cant be resident in both countries at the same time, and your husband as a family member only has the right to reside in the same country as you

Hi hafteem,

if you keep your residency in Italy you can't become a resident of Malta.

In particular your non-EU family member will get a problem and loose the residency title in Italy if you are away from Italy for more than 6 months while keeping residency there.

You should check out your legal position or just come as tourists if you don't won't to give up residency in Italy

you can be in Malta for up to 3 months at a time as a tourist, with no documentation required - is that what you are after ?

Hi Ricky,
Thanks, I know Sliema/St.Julians are expensive, but I need a place close to those area with good public bus and shops, am thinking in Msida/Birkirkara or a little bit fat like St.Paul or Qwara?? could you please recommend me a good place with rang 350euro??

I know, but my Husband and I will keep return to Italy from while to while before exceed 6 month, as I told you I will continue keep pay my tax in Italy,

Msida will be more expensive. Quawra,Marsascala,Zeitun,Zebbug could be cheaper. Birkirkara could be an option also. But they might not be that 'good' in that price range.

Anywhere 'close' to that area will be more expensive. Probably more than 350 €.

If you keep your residency in Italy you can just be in Malta as tourists and don't need to apply for residency. Of course you will be paying tourist prices for buses and everything else.

In that case, and as long as each trip to Malta is less than 3 months then you have no paperwork to worry about in Malta - you will be a tourist, not a resident.

ps If you exceed 6 months in any calendar year, you will be liable to taxation in Malta, irrespective of whether you pay tax in Italy

if the taxman in Malta considers you are working in Malta you will be potentially liable to tax in Malta on those earnings
