Urgent help needed!!

Hi all..
We just moved to Malta under 3 weeks ago and are already in trouble :( 
We moved to an apartment but soon realized this ain't the good home to us: this is smelly and my son hates the location coz here don't live any kids (even though my landlord said that here live!!) We found a better choice which is available in September and yesterd I sent a message to my lessr that we wanna move when this another apartment is available.
And he sent me message back that OK, I will collect your keys today!!

This can't be true, I've paid the rent until end of this month. What the heck I'm going to do?? This can't be legal??

A homeless with a child and a dog?? Any advices please...

calm down. first contact a lawyer, if you do not know anyone, try the law courts, maybe they can help you.
I do not think he can throw you out, but he can try to scare you because you ended the contract. if you feel unsafe contact the Msida police station. People are not put out on the streets here

That's what I'm thinking too. But still, this feels so unreal..
Can't understand why he became so angry about this?? I just said that I'm sorry but this apartment is not good with dog, he feels stressed all the time and barks quietly AND I'm not quite happy this apartment was dirty when we moved in..
So, does anyone knows here if he doesn't let us live here in August, where can I look for 2 beds apt with dog? We'll move to maisonette in Ibragg in 1st September so that area will be nice..

He is angry because he has lost a contract. I suggest, as this is an urgent case, you contact some real estate agents.
is it just yourself and a child plus dog? because even a one bedroom flat will do, just for the month.
if you google for estate agents in malta, or property in malta, i am sure you will find something

I have the contract but it's unsigned and there is not any mension what if I break the lease..
Only mension is that if I can't pay the rent within seven days, then letting agreement is automatically rescinded.

unsigned is very unhappy - in this case you should really going to contact a lawyer (as catch56 mentioned) and/or the real estate agency of your "new" flat.

However, without any other appointment the ordinary notice period should be 1 Month (if
the contractually duration of the lease is > 1 year) or 15 Days (if
the contractually duration of the lease is < 1 year).

But I can't guarantee for the correctness of the information - I'm not a lawyer (sorry).

did you get the lease thru an estate agent - if so go back to the estate agent he can help you

if not and no contract was signed its difficult either way for either party. did you pay a deposit? if you ve paid the rent up to end of month stay in it until you find another place. it will be difficult with a dog. but accom is about, the problem is finding it.

Thanks for all advices but this situation is ok now. This agreement was made without agents..
I got some help and now we are able to live here until end of August except the rent is higher. I heard my landlord is quite pissed right now and said nasty things about me but hey, at least we have a roof over our heads :)

Hi Sannis,

are you really sure that your 'quietly barking' dog is not part of the problem?

Whether your dog feels uncomfortable or ill or for any other reason, a dog that barks (what do you mean by quiet barks?) will cause you problems in most appartment building and areas.

Hi Ricky,
What I mean when saying that my dog barks quietly, I meant to say that every time my neighbors go out or in, he says one "wof". Coz he is not used to live in this kind of apartment. When we are out, he stays quiet and doesn't bark at all when all other dogs in this neighborhood bark. So I would say that no, the dog is not causing this problem. I know many many dogs which are more loud!
The problem was because I found us a new place (which is better to our dog) although we made longer agreament. He didn't like it and tried to punish me like this. But I think I hurt his pride when I let him know that this apartment was dirty when I moved and I wasn't happy with that (small) thing..

Hi Sannis,

That with the dog was just a thought! I hope you have more luck with your next place.

Even if you hurt his pride he got his way and you are paying his price! Only really careful consideration of everything around an appartment and the rental agreement including paying extras like rates and so on will avoid problems.
