EU National Info Needed!

Hi ALL!!

I hold both UK and Irish passports and my wife is a Chinese national

Under EU law it seems we have the option of moving to another country as we cant stay in my country because we dont meet the new UKBAs financial requirement.
Though as mad as it seems- my wife can be in my country if she was with any other EU national and able to live and work though me being from UK, she is unable and not allowed due to a British citizen needing to earn £18,600 per year.
We have around near £30,000 saving though opting not to live in the UK because of there discrimination towards there own people is why we wont.

We are both doing alot of research about other European countries on were we both can stay and be together
and i just want to ask more information about Malta

When arriving there and if intending to stay longer than 3 months is it possible to apply for an e residents card with economic self sufficient

Though say for example- an EU citizen is arriving there to look for work!
after registering with ETC can then the EU national go straight and apply for work and what documents will the ETC give the EU national!

When arriving there and if applying self sufficent with the required savings then what is the first thing a foreigner should do when arriving there,

Seems Malta have a few different forms to be filled out and different options of staying there if one opts to.

Any advice greatly appreciated

"When arriving there and if intending to stay longer than 3 months is it possible to apply for an e residents card with economic self sufficient" - yes, just need to prove sufficient income or capital and health cover

"We have around near £30,000 saving" - thats sufficient for the financial requirement

Hi Concon and Joejoe,

your Rights are through the Freedom of Movement Act within the EU which actually implies 'movement' to another EU contry. Otherwise national regulations apply. The income threshhold  for Maltese citizens living in Malta wishing to bring their non-EU spouse or partner to Malta are 10.338  !

As an EU national under your circumstances you can either register as looking for work with the ETC and register for residency , register for residency with a work contract or as economic self-sufficient ( either 23.300  capital or 108.63 /week income). In all cases your wife's residence application depends on your own residency and you have to apply for her.

You have to show that you will not be a financial burden for the state of Malta and that you have adequate health insurance (coverage) for both of you.

You should and have to a register yourself and apply for your wife immediatly as her visa will probably expire otherwise and that could cause difficulties as her legal status will be checked on application and if her visa has expired there will be a lot of head shaking at the Evans Building!

Cheers
Ricky

As an EU citizen, you have the right to live and work in Malta (subject to the conditions I mentioned above), and your non EU wife has the same rights, but her rights only come into force once you have taken up your rights, by applying for your eResidence card.
