Started Working. When to Apply for eResidence

Hi all,

I am a little confused.

I have just started work and my wife is due to start at the same place as me next week. I am British and she is non EU. We have been in Malta for around 6-7 weeks and our understanding is that we cannot apply for eResidence until we are working, which we are/will be. I have some forms to fill out for the company not a problem, and one is for the Inland Revenue for tax. Can I apply for eResidence using the details I have for the company and the forms I have which I have filled out? (these forms have attached the company details and it is signed below) or, do I or should I wait for a contract from them?

The reason I ask the above is that my wife has been asked by the company to go and apply for eResidence but she doesn't start work until next week. How is this possible? I understand we would need marriage certificate and work contracts to proof employment but we don't have a contract just the company details. On the eResidence forms it asks for a copy of and original of work contract.

Hope the above makes a bit of sense. Hope someone can advise.

you would need something as proove your working for the company , ie a work contract  to apply or a copy of your engagement form. .. your wife who is non eu would need a work permit to start work (if she hasnt got one already ) you dont have to apply for Residency untill you have been in the country for 3 months , but nothing stopping you applying earlier , if you have all the documents.

make sure you also have proof of address they don't ask on the forms but do when you apply

The only thing is that my wife does not need a work permit to start working which we confirmed with ETC and the ID office. She just needs to provide our marriage certificate as proof she can work. I know that for me my permit is done and granted automatically and my wife would also need a similar thing which the employer does for both of us. All this was confirmed with ETC and the ID office after we had some confusing information on here a while ago.

The problem is that our work place is fine with me (as British) but asking my wife to apply for eResidence which doesn't make sense as she isn't working until next week. I can't apply with her until I have the work contract. All I have at the moment is a Inland Revenue form to fill out as well as some other forms to give back to the employer. After this I know that I will then get a contract given for me to sign etc. Then I can apply for the residence. The most confusing part, is that my wife has been asked to apply tomorrow? we both are working at the same company and communication within the company is really good. So they know who I am and my wife.

She was asked to provide her marriage certificate and a national ID or something similar to them. I know that the ID and Residence has changed and it is now eResidence. So confusion is still there.

for an e-residence permit, working route you would need either proof of employement,  or you register as self employed - your wife wouldnt be granted residency without being able to proof she is working , i.e. contract ... so the employer wants her to apply now they need to provide the contract now .
without it it would be a waste of your time to go and apply without having the correct proof etc

she can apply for her , social security number now by visiting the correct dept,

Hi Chris,

you have to apply for your wife's residency immediatly as she is a non-EU citizen and her right to stay in Malta is not automatic but depends on your registration. Her right to work without a work permit is due to the fact that she is married to an EU citizen but she also needs the residency otherwise her visa will expire after 3 months.

It sounds confusing but isn't really but it is a bit more difficult getting things going in your situation. Why havn't you got a work contract from the company yet? That seems to be the only problem Your wife does not need a work contract when you apply for her residency.

Marriage certificate, proof of financial backing or job or job seeking and health insurance are neccessary .

Hi, my husband didn't have a work contract either so they told him to ask his employer for a note on a letter head to confirm that he does work there. He did that and they accepted it no problem.
