Employer threatening me to work against my Employment contract

My General Manager threatening me to work for another division, if not he will put absent for the days i am not working for that scaffolding division.

1. currently i am working in civil projects as per my Employment contract.

2. in offer letter clearly mentioned civil division and site engineer.

3. Manager threatening me to go and work in Scaffolding projects (Since that is not mentioned in My contract , i denied)  other wise he will put absent for me.

is it legal or what i suppose to do?

Hi sam kannan,

Obviously what your employer is doing is illegal. But it comes with some unpleasant strings attached.

Legally and technically, you must do only what you have agreed to do, as specified in your employment contract.

If your employer is threatening or forcing you to do what is not mentioned in the employment contract, you are free to complain against this discrepancy to the Ministry of Manpower, through their website.

Action would be taken against your employer - mostly as fine and warning.

But this would sour the relationship between your employer and you for sure, making it even improbable for you to continue working for the same people against whom you had complained.

An amicable and a cordial way out would be in your best future interest.

So think hard on your next course of action.

Today i got IOM form my general manager you are deputed to Scaffolding division
he verbally informed salary will not be payed with effect from today if not going to scaffolding division. (he refused to give in writing)

Note:
1. my visa expiry date is 09/09/2017 & not willing to renew & not even want to work in oman (11 days visa remaining)

2. Today only i given my Resignation letter, because this month 08/08/17 my management (HR & GM) agreed to pay my End of service benefits by 31/8/17. My 3 months salary is  pending now.
(HR terminated me on 8/8/17 but not given termination letter)

3. My mother got Brain stroke & admitted in hospital, so that i want my settlement as soon as possible.

4. If i complaint to ministry what will happen to me or shall i complaint in Indian embassy (Yesterday one employee expelled  from camp for  going to labor court)

5. in case my employer not giving food & Accommodation for complaining in ministry what should i do ?

6. if i am continue working in current division will they deduct salary by putting absent? (how to prove i have worked for Electro-mech division)

if employer not giving proper final settlement what should i do.

before exit visa  is any Oman government official in airport ask us
are you satisfied with your settlements (if any govt official ask such things please explain)

if i tell i am cheated by employer by not paying for working days what proof i should have, please explain

Hi sam kannan,

Your HR Department has terminated you ... you have resigned ... you are being threatened ... your 3 months salary is pending and has not been paid by your employer ... you have got emergencies at home ... and, there are more concerns too !

With so many issues to be resolved, you cannot do anything by yourself.

Immediately seek professional help and support.

Go to the Indian Embassy with all the details and documents and lodge a formal complaint against your employer and all their unfair activities.

Then go to the Ministry of Manpower and do the same. Preferably take some Omani colleague with you who can speak for you at the Ministry. If you go by yourself, they will not entertain your request. Or, you can also lodge a complaint against your employer online in the Ministry of Manpower website.

The authorities would only go by what is written on paper. No oral instructions by your employer would be held valid. So don't worry.

Also, while exiting no official will stand there and will ask you if you have been handed over all your settlement or whether you are happy and satisfied leaving Oman ! Get real.

See, when things have gone this far, you must only try to get your settlement and your pending salary amount, get your employment visa cancelled and exit amicably without making it any messier than it is already.

i need what are all the documents for complaining, and after complaining in ministry of manpower my employer may expel me from camp.
where should i get accommodation ?
please give solution for this consequences, i dont need any oman job & ready to go india permanently.

Since you are an Indian national, and since you are living in a foreign country, in cases of emergencies, the Indian Embassy would provide you with the required assistance. Approach them.
