family reunion refused

Can any one of you please help me with following two set of questions,

1. If applicant (from India) is covered with mutuality of the spouse from Belgium, does she still need travel insurance visa for type D long term visa? If yes, for how many days extra insurance is needed and can we buy an insurance without knowing the start date yet (since the start date would depend on when visa is approved)?

2. If a visa is refused , does the applicant need to do the police clearance and medical check up again even applying within one year of first application? Since Police clearanace was apostilled , and police clearnace has to be done again, does it mean it has to be apostilled again?

AnkitaTejee

Hello,

You definitely do not require a travel insurance if you are covered under your spouse.

Plus yes you need to do the each document fresh for a new application because, even if you apply within a year, the 6 months validity of the document expires.

For example, i got my visa refused an i had to renew all the documents, because there is a big chance that they reply you in almost 6 months and by then your documents are too old for new application.

Hope aligned.

DASD

Thank you for your answer. May I ask little bit more clarification on all docs need to be redone?
I am primarily concerned about how apostilled documents are handled in a resubmission.
For e.g. My understanding is Birth Cert, Marr Cert which were apostilled can be produced as is since they are not time dependent; however PCC need to be redone since it is time dependent.
PCC was apostilled, so does it mean it has to be apostilled again?

(I do understand that the administrative fee has to be repaid, all the earning details has to be produced anew, medical check up is needed to do again since more than  6 months have passed etc.)

AnkitaTejee

Hallo,

i got my BC/MC/PCC reissued since these documents cannot be 6 months older.I understand when you say they are not time dependent, but there is always an issue date, which needs to be latest 6 months old.

Hope its clear. Shout out in case of any other concern.Happy to help.

DASD

Dear Ankita, Thank you and can I request you to provide me some more details from your experience as we are facing some issues in re-issuing MC back in my city.
Do you know if it is an application for getting a duplicate copy at the marriage registration office or is it a xerox of original stamped by registrar stating the xerox as a true copy? The issue is I was told that it can take approximately 2-3 months to get a duplicate MC. Was this the case for you also? (It is special marriage act)

AnkitaTejee

Hello,

Yes mine is special marriage Act too, but the reissue of MC depends on the administrative rules of the city you have registered.Mine was from New Delhi, wherein i could get the same certificate immediately from the online database, so technically its just a copy of the original with the original date of registration and no mention of the print out date. In New Delhi, there was no such case of Re-issue.

So what i did was got it stamped by the registrar in power with a date(this was on terms of understanding the case, she was a bit reluctant, but i managed).

But i think if you clearly mention in bold in your cover letter that you cannot get a re-issue with present date, they will comply.

So, please ask them clearly will it be exactly the same? or will it have the new date on it of re- issue?

Other wise follow the above, I am sure the embassy will understand.
P.S get it apostilled

lial1005

Hi there,
May I know the reason of the refusal?
I am applying also for my husband visa.
Thanks a lot.

AmitS01

1.Hi... I am also facing same issue as in Mumbai they flatly refused to reissue marriage certificate... What to do in such case...
2. Also does apostille also needs to be within 6 months old? I mean I have My MC apostilled a year ago... Will they put another apostille stamp on the same one??
3. If I apply my wife and child's visa along with me... Is it granted at the same time or they will take longer??

AnkitaTejee

Hello,

Please read the above for answer to point 1.

Point 2 Get a new copy printed out if online, or else get it appostiled again on the same, Please write the precise situation on the cover letter.

Point 3 i HONESTLY HAVE NO IDEA

AmitS01

Hi Ankita
Thanks for reply....
I didn't understand above post...
Cover letter to whom we should write
And does registrar gives stamps on the
Copies of MC?

AnkitaTejee

Hi Amit,

A cover letter is an description of your reason for applying your visa, and also the documents you are attaching, or any other relevant information regarding you documents or travel. It is a must. Please in box me your Email id .

You can personally ask the registrar to sign WITH A DATE , date is important with a stamp on the new copy. If he or she denies, explain in the cover letter to the embassy.

DASD

@lial1005 The reason for refusal was the financial documents were not in order. They did not take into account bank  statements, contract, instead they need something like last tax paper, payslips etc.

DASD

Hi Ankita, Thank you for all the invaluable tips. One (hopefully) last question, since MC, BC, PCC, Affidavit are all in english ,  did you have to get it translated by a sworn translator to a local language? Please explain bit in detail if you have done it.

Aneesh

Documents in Engish are accepted by consulate. You dont need to translate those for visa application.
