Immigration law enforcement - Take care !

The thing I find in the DR is that what is in print is not always enforced. Or sometimes they put it in practice and other times not.

I'm not buying this who is your friend and how can we contact him to confirm this?  I will pay him $100 to prove this happened.  I know a lot of people one who overstayed 3 years and came back last week fine.  And this is your first three posts ever...

I know alot of people who play the lottery and never win but we know that people do win the lottery

Not sure who you are referring to with your request for proof.

We know there are some cases, but we do not know full details. Leave it at that for now. More will come out, it always does.

Several years ago I posted that a list was checked for my name as a potential over-stayer.... although true I got hammered in the site as being a naysayer..... stopped posting and still keep a lot to myself ....

OR it spreads needless fear for no reason to others.  When I first started coming to DR I saw one of those posts and flew back right before my 30th day and flew back FOR NO REASON.  For 6 months I flew back right before the 30th day and flew back a few days later to be with my wife because I listened to someone posting things like this guy that arent true and just unconfirmed nonsense so forgive me but I don't take it as preventing people from coming forward.  If it is true he could easily back it up with citing the source of information by giving the persons Facebook or asking the person if he could be contacted to verify.  Of course he wont do that I already asked and he didn't just kept posting nonsense about not everyone wins the lottery.  Its bogus!

You don't have to believe anything I post just use common sense if you have any,if your somewhere your not supposed to be sooner or later bad things can happen and when you overstay your not supposed to be here,just common sense

And by the way what I told you was first hand info I went to the airport to pick him up and he was being held in a detention room with 3 others,I was allowed to see him and bring him food

Ok, so can we contact this person then please so that we can confirm exactly what happened?  I hope you understand to some people this is a serious issue and there are many people like yourself who make up things and post them online.  So, if its true its not very hard at all to provide the persons name and info so I can contact him to confirm because I doubt they just picked a person at random and did this.  There has to be more to it.  He probably had a visa and overstayed or SOMETHING besides just being in the DR for 18 months before....I don't believe it at all your just telling stories.  Back it up with PROOF.

Look, we are trying to stay reasonable on all  of this. We neither want to fear monger nor bury our heads in the sand.

Reality is something is going on, people need to be aware and do what they decide to do!

never get enough?  You haven't provided any proof at all you've spent so much time writing all these posts instead of backing up your story with proof or evidence.....why? Why wont you show proof? Your taking all this time but providing 0 evidence.  If it was true you could EASILY back it up with some evidence and I would say wow look at that I was wrong.  But you haven't and you not going to because there is none.

STOP right now.  Both of you.  There is enough weight of evidence to show that things are changing. Very very few people are going to be willing to put their name and phone numbers on open forums. In fact we won't allow it!

I've said more than once I'm the proof or evidence as you call it, I witnessed it and was there the next morning when he was put on a JetBlue flight back to NY and mind you he had to pay extra for changing the date of his return ticket and if there was no room on that flight he would have been put on a flight to Miami,he was told by immigration that their only responsibility was to get him to his home country not his home city

There will always be people that don't believe until it happens to them.  Yes you have stated you were there and saw it with your own eyes, but that is not good enough.  There had to be something else.

Now, do you get that $100?

He overstayed his tourist visa many many times over the last few years never had any incidents of trouble with the law they just mailed him for repeatedly overstaying and now he's banned for 18 months

What do you want a notarized affidavit?I just posted info that I witnessed first hand you take that info and embrace it or you chuck it down the toilet,makes me no difference I'm a resident

One last thing you can tell mr.scott if you have an accident in this country and someone is hurt or God forbid killed you will go to jail until the police figure out who was at fault unless you have an additional Rider on your insurance policy called " casa de conductor" then you will be kept in a hotel and fed until the police complete their investigation but that's only valid  if your legal in the country if not it's lights out,I've heard people say their foreign license is good for 90days that's not true at all, if your here on a tourist visa on the 31st day you and your license are no good in the country

JRP55 is correct regarding the license period legality being valid only for 30 days on a tourist card,  and also regarding significance of Casa de Conductor.   Enforcement of foreign licenses is very lax on the north coast. Admittedly they let people drive well after 30 days.   

I don't know of anyone yet that has needed Casa de Conductor, but we certainly have it on our policies. They will put you on jail otherwise while the details of a major accident get sorted out and jail here is not a place to be , ever.

We want to come back but we will follow information on the forum before we decide.
As I said we come for about 80-89 days each year, pay our fine on departure and that's it.  I just looked at my receipt for this year and there is nothing on it, only confirming the payment for the fine.

I know I may be stating the obvious but one would think if there were a problem they might signal this on departure or perhaps I am being over simplistic.

Any way we would love to come back so we will wait and see.  Thanks for all your valuable advice to date.

Forget what may or may not be on a receipt when you came into the country you went thru the fingerprint scanner that gives them all the info they need as far as entry and exit

Lest we forget, there are 3 recent reports of denied entry on DR expat.com. One in the anglophile forum. Two in the francophile forum.

Scott, don't worry, as I have said many times, it depends.  In this case mostly on you, your attitude, positive behaviour, friendly smile... In most cases when I came back from a 2 or 3 week vacation after leaving the DR, overstaying for a year or more and have paid my fines on exit, I came back VIP (bypassed the line-ups, breezed through customs), off the plane and in my car in 20 minutes or less.  It's all about you.

Having said that, I now have my residency.  Why, because after living in the country for 5 years I was ready to take the next step...

People should never forget we are nothing more than guests in this country for 30 days and just like a guest in your house you have the right to tell them to leave at any time after those 30 days,don't think it can't happen here

I know I'm late to the party, but I was denied entry at SDQ on Wednesday and detained for 4 hours before being escorted onto a plane to Miami.  All because jefe was pissed I overstayed 4 months before leaving in May.  How do I remedy this so I can return to my apartment in las Terrenas?

Well, a first hand report. It does happen

DGM and indeed foreign missions have been  advising that those denied entry from an earlier overstay will require at the least a visa other than tourist card for re entry. Now a residency visa may be your best route to re-establish your life in DR. Can you qualify for residency? If so start it now with the help of an immigration lawyer.

Get yourself legal. 

I would recommend contacting a major law firm for your situation.

Then work thru them to get yourself legal by obtaining residency.  Hopefully, "jefe" (as you put it) won't hold your prior flouting of the DR's laws against you.

To its credit, DR is growing out of the banana republic heritage. Part of that is having immigration laws that are enforceable and enforced.

The unfortunate poster states he is retired and as such should qualify for residency through that particular investment route. Contact Lishali and apply for the residency visa is my advice

Put your house in order by getting residency and continue your DR retirement.
