I have a few questions regarding the application process for residency based on having a Brazilian Child

1. If the solicitant (parent of Brazilian child) is currently irregular (on expired tourist visa) will this affect approval of application? Is the person required to pay tourist visa overstay fine (now ridiculously expensive or just GRU taxes to get protocal?

2. What type of proof of economic subsistence does the solicitant need to provide?

3. Is the declaration of custody legally binding ?

4. In your post you mentioned that in liu of authenticating documents, original documents can be presented to the public server, is this still the case, has anyone tried this and It worked?

1. The Federal Police will almost certainly insist that the fine be paid before they process the application.  Best plan is probably to pay the GRU for the application and file it first, then pay the fine if they bring it up.

2. A signed declaration is usually sufficient.

3. Your name on the birth certificate should establish custody.

4. You can show the Federal Police original documents, but you should have copies authenticated by a cartório for them to keep.  All documents not in Portuguese must be accompanied by a translation prepared by a Sworn Translator to be accepted.
