Firing from job without notice

Hello everyone,

I am in trouble and need your advise urgently because I am very new in bahrain. Its been only 3 months.

I have had a dispute with my employer regarding my jod roles. I am Chartered Certified Accountant but from last month, I am being treated like office boy by my employer. There are a lot of other details regarding dispute but there is no benefit of explaining here.

So, after feding up, I asked them that I cannot work like this and with this type of behaviour. And they said that we have invested in you for  months for no reason. I am paying you for nothing. Either pay back all visa costs and salaries or continue working. Think about it and tell us tomorrow.

So yesterday, I went and said that okay I want to continue but I will only do the work according to my job description. I will not do any admin etc related work. And his reaction was extremely poor and threatening. That now you will give me orders? I pay you. You dont pay me etc etc pack up your bag and go back to your country. I said if you want to fire me then u can cancel my visa and when I leave is my problem. He said in aggression that dont teach me rules and regulations. He brought u here now pack up your bag and go back.. Tell us exact date when  u r leaving and we will proceed accordingly. I think that he has a plan to cancel my work permit after I leave bahrain, report me as run away.He also said It will take me 2 minutes to put you in jail. And if you run away and stay in bahrain, i will make sure that you go to jail.

Now I have many questions

1: What can I do now if I want to stay in bahrain in proper way because employer has not given me any proper notice of firing and also not cancelling the work permit. I have heard that one can stay upto 3 months in total after visa cancellation. One month grace and then 2 extensions And I want to stay because I am very hopeful of getting good job here.

2: If I leave now without visa cancellation as my employer is saying, what are the worst problems that I can face later? Because I am worried. My occupation is Accountant in work permit. After leaving if my employer file run away case againt me and also file that run away with company cash 50 60 k Bhd. Although, he would not have a proof but run away itself is a proof that employer is right.

3: If suppose I am being black listed in bahrain after leaving, will it have any impact on my visa processing in other GCC states? Because after leaving from here in worst case scenario, I have a plan to move to UAE.

4: Can I send a resignation through post to my employer with imediate effect because of abussive behaviour and physical threats instead of asking them to cancel my work permit? I have heard that normally employee cannot resign in first year of employment.

1) One month after cancellation and as far as I know, one extension is easier.  Subsequent ones are not guaranteed
2) Yes he can file an absconding case against you
3) Not right now but they have agreed in principle that at a later stage they will apply labor bans across GCC.  Right now, it is done only for criminal cases
4) No that is untrue.  You can resign but you cannot get mobility without consent

I would suggest to:

1) Send resignation via registered mail and retain the slip
2) Go to Ministry of labor with all evidences and file a case
3) Take 1 & 2 above to LMRA and request for visa cancellation / register the issue

That way, you safeguard yourself against future problems.

On your suggestions:

1: What explanation should I give in resignation? Should I mention details as to why this resignation is not a one month notice, instead it is with immediate effect? And also mention that you have fired me without formal notice ?

2: Regarding evidences, everything is verbal. How I can provide evidence?

3: Is there such option available that LMRA cancels the visa in certain situations instead of employer applying to LMRA for cancellation? And if LMRA approves my request and cancels the visa, will my position be the same as for individuals with cancelled visa in general? In other words, if my visa is cancelled this way by LMRA, if I find a job, can the new employer apply for my visa or do i need to leave the country and cant hunt job in grace period?

1) Standard resignation.  State that you are willing to serve one month notice at the discretion of the employer.  You can only resign with immediate effect if you want to forego your salary or have your end of service benefits deducted in lieu of that

2) Take all documents you have i.e. contract, resignation, a written application explaining the circumstances of the dispute, copies of passport / CPR, copies of salary slips etc etc.  Then explain the situation and file a case.  Get a copy of the reference number and take all the same to LMRA

3) They don't cancel that easily without employer consent or without certain conditions having been met.  However, the purpose of going to them is to put the whole situation on record so you avoid absconding case in the future.  All cancelled visas are the same irrespective of why they were cancelled.  You can job hunt during grace period and your new employer can apply for visa without you needing to leave

Sorry to hear this. So happy I’m out of there! Plenty of these cases due to highly unprofessional management in so many places. These managers have a seriously poor understanding good work ethics.
