EP Rejected

Hi All,

I am changing jobs and recently my new employer applied for EP
My EP got rejected recently by MOM stating the reason as:
The salary offered does not seem commensurate with this candidate's experience and qualifications. You may wish to look for a more experienced and qualified candidate


Offered pay 6700 SGD

Previously I was on EP then 4 months ago at time of renewal I got downgraded to S pass.
Reason for rejection of EP at that time was

This candidate no longer qualifies for an Employment Pass based on our tightened criteria. You may wish to consider leaner manpower options or to recruit Singaporeans on merit. If you still choose to keep this candidate, do consider if he/ she is able to command a higher salary for the value he/ she offers. Before you do, use MOM's Self Assessment Tool (https://services.mom.gov.sg/sat) to work out what you would need to pay this candidate for us to consider your appeal. You may also consider applying for an S Pass for this candidate if you have available quota. Otherwise please select a more qualified person.


At that time my salary was 6000 SGD.

Today I did a SAT and it shows I need atleast 6500SGD to be eligible for EP.
Please help

Their reply indicates that MoM thinks the offered salary is too high for your background.
Your employer could now appeal with a reduced salary, or follow MoM's recommendation of looking for another candidate.

My employer is appealing with same salary but a good justification on why they need me. Do you think this will help?

Unlikely, as the stated reason is you, not the company's need (and in addition, MoM obviously thinks other candidates are available and more experienced ones would be more suitable).
Do not resign from your current employer yet!

Yup I am definitely not resigning unless I have EP or S pass.

Can you tell what options I have after the appeal is also rejected. Can my employer re appeal? or re apply? (Can he re apply for S pass also ?)

Also how come MOM thinks 6700 is high when SAT shows that I need minimum 6500 for EP?

Rejection of an appeal is final. If S-Pass is also a possibility, the employer would have had to indicate that in the original application - afterwards is not possible any more as far as I know.
They could only apply for you to join on another job.

You'd need S$6500 for an EP, but you would be overpaid at S$6700. Most probably you can only get S-Pass.

But now I think according to https://www.expat.com/forum/viewtopic.php?id=828220 the rules have changed as stated by surya in last post? So it means company can later apply s pass?

You might be right with that. Your employer should definitely try!
