Bond period and penalty

Mr_Mister

Hi,
I signed the offer with my current employer that I have to pay a certain amount of monthly salary if I resign before 1 year. I wonder this is legal and I have to pay in order to leave that company?

beppi

You signed the contract and thus agreed to its terms.
Why should that not be valid?

Mr_Mister

Have you get experience on this situation? Or any friend of you has?

beppi

No first hand experience, but I knew people who had such a clause in their contracts.
Why?

Mr_Mister

And they have to pay in order to leave?

If the employer asks you to pay you have no choice other than paying as you signed the contract. Even MoM won't do anything in this regard. The FAQ section of EP on MoM website states - Employer and Employee should themselves amicably settle contract matters.

Of course.
If you don't agree to such clauses, don't sign the contract!
