[Urgent] Convert ICT Karte to Blue Card

I am currently working in Germany on deputation for an Indian firm on an ICT Karte which is valid till December 2021.

I have been offered an unlimited employment contract by a German firm with Date of joining 01 Oct 2021 which makes me eligible for Blue card. Auslanderbehorde (immigration office) has confirmed that an appointment for applying blue Card can be booked only in mid August due to pandemic.

I resigned from my current company in order to serve notice period of 03 months before joining new company. Post resignation, my current employee is asking(forcing) me to return back to India on 20th July to complete my remaining notice period in India.

I have following queries:

Once I return to India , I will not be able to attend the appointment in mid August for my Blue card.

Also will my RP card(that I am currently holding with my ICT) be valid once my employer sends me back to India on 20 th July.Can I use it to return back to Germany and attend my blue card appointment??

What are the options I have in order to guarantee/confirm my permanent job with my new employer in Germany??

This exact post was put here on the forum a month ago. Doesn't seem likely one will get other responses for the same question.

And such questions should be answered directly by the immigration officials; so why not simply ask them rather than looking for other's opinion about what they might say! Immigration is happy to have highly qualified workers come and make sure they do the paperwork correctly. It's not like it is an adversarial situation. Just ask them.

As Tom mentioned, you have to explain your situation to the Ausländersamt like you did here. They surely will help you. Dont leave before you have a confirmation to coming back from them.

I don't think your current ICT visa will still be valid after your employment ends and you left the country. Better get another (visit) visa to attend the blue card interview.
