Single Permit Processing in 2022

Hello!
My employer applied for the single permit application on 8th August in Flanders region. Iā€™m waiting for the work permit (WP) and residence permit (RP).

I provided a French address and the documents such as medical certificate and police certificate while my stay in France after studies. Now, my French residence permit is about to expire (20th October) before getting the WP and RP. So I have to go back to my home country and wait for the decision.

My questions are

What shall I do when my country of residence changes during processing the application? (My employer used the French address, but I have to move to my home country during the process.)
What shall I do if the address in single permit application and the one in the visa application are different?
Any impacts on my application decision?

Any suggestions are welcome. Thanks in advance!

Please be carefull about changing address, i remember once case of my friend who was in germany at the time of application and he provided the same address and then moved to Pakistan, what happened was he was not able to apply they visa from Pakistan as his single permit file was sent to Belgian embassy in Germany not Pakistan and because of this he lost the job as the whole process needs to be restarted. Also to apply visa from France i think you should have a valid french residence permit. You can check with immigration authurities and if you plan to move to another country may be you can provide that address to avoid problems.

I hope not because it will not be fair then.

I don't find reasons that this process to be selective because it is not only workers that wish to go to Belgium to work but also Belgian employers that need people in their businesses.

We are not asking a visa to go to look for a job in Belgium, we already have found the job in fields where Belgian government has declared as jobs not frequented or job in need for extra personel, we have found the employer, we paid insurances, we have found a place to live, honestly don't find reasons that to be true.

In the other hand I se people that have applied later than 1 August for the single permit and have already got the WP and maybe RP.

Really don't know what to say.

Just I will hope it will not be true.

@katete same here! I applied on 1 July and WP was approved on 7 July and yet I'm still waiting for RP.

It is also good to mention what region did you applied. As I know Flanders takes more time

With WP approved

Previously, I put a temporary address X in the contract where my employer is already aware of

it. I have a valid RP in YĀ  till December.does it affect my application?

Will the annex 46 be sent to the Belgian embassy in X or Y?

Hi guys.

Just an update and a question because they ask me something that I'm not sure what it is.

26 September 2022 Flemish office asked my employer exactly this:

Betrokkene heeft geen geldig verblijf in Belgiƫ. Gelieve zijn paspoort met visum en stempel uit land te bezorgen.

English:

The person concerned does not have a valid residence permit in Belgium.Ā  Please deliver his passport with visa and stamp from country.


What I don't understand is that, I don't have a visa because I'm waiting for the RP to get a visa.

Would it be enough to send just a copy of all the pages of my passport?


Date applied 1 August and 26 September was the first reaction from the office.

You should ask your employer if they applied for your single permit as someone already legally residing in Belgium. This is the only reason I can think of why the authorities would ask such a question.


PS: Your employer should NOT (have) apply(ied) for you as someone already legally residing in Belgium. Your application should be as someone OUTSIDE of Belgium.

We applied via a relocation agency of my company. It was mentioned that the work permit approval takes 4-6 weeks. However, we have not received any response yet. Does anyone know how long the approval of the work permit and whole process take currently?

Also, how long it takes to get the visa in TURKEY after single permit approval? I would appreciate it if you could share your experience with me 1f643.svg

This is what I think also. Before I apply for the single permit visa I have lived for some time in Belgium with a orange card, but when I applied I have been in my home country and the orange card was ended.

When I did the application the form asked me for a national Belgian number and it was not possible to go further without filling that field, so I put my Belgian national nr.

It looks a little bit messed up....


Any further advice?

First of all, you are NOT supposed to file a single permit application by yourself for yourself. The law REQUIRES your employer (or third party agency working on behalf of your employer) to make the application AND payment of the application fee(s).


Secondly, yes, you messed up big time by filling out an already EXPIRED national number in your application form -- this is why it is the responsibility of your employer's HR and/or legal department to handle single permit applications. You mentioned that "it was not possible to go further without filling the field", but more than half of users/commenters on this thread have applied/are applying from outside Belgium withOUT a Belgian national number, yet, our applications were successful. Again, this is/should have been the responsibility of your employer, or, if they are not well-versed in the single permit application process and requirements, they should have outsourced it to a third party agency that deals with this.


The implication of what you did is this: you applied as someone legally resident in Belgium, whereas, you are not and therefore, have no right to have applied as being legally resident in Belgium. Yes, you did not know, but the authorities won't understand/interpret it as such. They just look at what the law states and make their decisions based on that. Having lived in Belgium for 2+ years, I know firsthand that Belgian authorities never deviate from anything that is already written in black and white.


Next time, make sure your employer or their third party representative is the one filing your application, NOT you.


Other than that, I don't see how this works out in your favor. Even if you send a copy of your former orange card, they will see it has already expired + they already have your record in their system.

Well, I just helped my employer with information, links and to fill the form. All was made by him in his name and business address.

What I think, we made something wrong during the application form but we choose the option as someone living out of Belgium. I don't understand why the system asked for a Belgian national number.

We have two weeks to send the required documents. My employer will try to get in contact with them and explain, maybe I have a chance. Otherwise I will pay the same costs by applying from the beginning and wait all that stressful time.

@aldishuli when RP gets approved, you receive the Annexe 46; thereafter need to apply for Annexe 49 to start working officially. In meantime, I already submitted the documents for change of status with regard to the visa. Still to get the invite from the commune for submitting the biometrics.
