@Expat_1034 As we are assuming you are not in Belgium and you have D type visa but not any annex. So as long as you have Work Permit you can work independently from any Annex.

Once you have your Work Permit and Annex 46 : Gotta go to municipality and apply for Residence Permit (A card). Then in the municipality an Annex 15 will given during your Residence Card issuing.

If you explain your circumstances then much clear answers would given.

Expat_1034

@maharaji1984 Hello, thanks for your response.

* I'm currently in France (on a student residence permit)

*I have received my work permit, Annex 46 and Type D visa as well.

*My work contract starts on 1st of February 2023.

I haven't moved to Belgium as of yet because I don't have an accommodation there so I'm trying to find an accommodation before February starts. It's unlikely that I'll be able to find a permanent accommodation before 1st of February.

So basically I wanted to know if it's legal that I move to a temporary accommodation and start working on 1st of February without registration at local commune, in other words, without getting Annex 49?

I have read in few places that I need to register myself at local commune within 8 days of arriving in Belgium, my case is a bit different because technically there won't be any entry stamp on passport (from Belgium) since I'll move from France.

@Expat_1034 I have learned that first application", employees are allowed to already start working with the annex 46 (so no need to wait for the annex 49). Good luck!

SP_chaser

Hello all,

I have a question regarding to the single permit process, I have received an email from my company with two pdf files at the same day 06/12/2022;

1-  Admissibility Notification to Applicant – SP

2-  Transfer of admission to employment to DVZ - SP Fixed duration

In the first one it states;

“We received your application (Single Permit - Fixed term) of 11/10/2022 in good order. Your request has been registered and found to be complete on 06/12/2022. Within 120 days a decision will be made. As soon as the Economic Migration Service has taken a decision on the part employment, it will be forwarded to the Immigration Office, which will issue a will make a decision regarding the residence hatch. You will be informed of this in writing brought.”

In the second one it states;

“We hereby confirm the transfer of the favorable decision regarding your application for work (Single Permit - Fixed duration) to the Immigration Office, concerning the employee:

The Immigration Office still has to make a decision on the admission to stay. This means that the permission to work is only valid if the Immigration Office takes a positive decision on the application for a single permit.”

Both documents are dated on 06.12.2022. Does it mean they have 120 days starting from 06/12/2022 for RP although the application was made on 11/10/2022? Or I may expect the RP/Annex 46 anytime now?

Thanks and good luck to all!

maharaji1984

@Expat_1034 There is no problem with your working from 1st Feb. Accommodation as well . It's quite hard to find an apartment/house easily .So while you are  on your temporary accommodation , you can continue to work and look for your permanent place.(thats exactly what i have done before.) Good luck in Belgium :)

maharaji1984

@bersine Hi bersine, May i ask if its not going to be rude whats the annual gross salary to being "high skiller worker" and whats your job?

As far as i heard they are first looking on the local market from the citizens if there is an application as  "high skiller worker".

How long time did it pass from your application to get WP?

Ameh95

@maharaji1984 You can find the requited information on the official site below:https://economy-employment.brussels/permit-highly-qualified-or-director

I have a question which appointment I should get for getting my annex 49 from city hall? Is it like renewing residence cart (verblijfcart niet-belg) or other appointment?

Zaza00

@Ajahan I would email your commune. In Ixelles they told me I could just come in without making an appointment.
