Good evening lovely people, I was a student in Spain and I came to Malta last year with a valid residence card. I got a job offer at a company in gozo and they put in for my single permit process. They rejected it twice on the basis that I’m in Malta illegally which is not so. They asked for evidences which are my passport stamped page when I arrived Spain, my flight ticket from Spain to Malta and my residence card which I provided all and resubmitted. The application has changed status from ‘submitted’ to ‘In Progress’ but my fear is that it has been like that for more than two weeks now. Should I be worried?

I will greatly appreciate your kind responses.

As a TCN, having a residence card for Spain does not mean you can reside in Malta, you can visit for 90 days but then have to leave.
Since Brexit it is the same for me as I am now a TCN, I have lived in Malta legally for 9 years and have a 10 year residence card but if I went to Spain, which I can without a visa, I could only stay a maximum of 90 days.
You can not be resident in Malta till your work permit has been granted.

If you have failed twice, then go back home and follow the correct procedure. No one here can help you as we do not work for the Maltese government.

You also don't wish to be deported because if you were, you could be banned from entering Schengen Area for 10 or more years.

Your 90 days would only be valid if you are here as a tourist, if you have got yourself a job you are not a tourist and have to wait to move here and take up residence untill you have your work permit, in the meantime you have to go back to where you are legally resident.
