Annulment process step by step

Post new topic

RODNEY9999
Hello,
Questions about annulment are regular topic of this philippines forum.
In 2 words, we know that it cost between 250000 PHP and 300000 PHP for a 2,5 to 3 years process.
However, it seems that a detailed process was never described (the way to find a competent lawyer, documents to provide, terms of payments,
« bribes » if any, interview with medical or a judge, trouble if any the « ex » husband, what to do or to not do …)
Could some members share their own personal experience step by step?
Thanks by advance.

I have never heared of anyone trying to do it self.
Often there isnt any real reason Philippine law accept, so it can be making up a "reason" case to case,  Some lawyers are specialists at making annulments geting approval.

Muslims and I believe tribe people too have some extra chances by some different for them.

There is a glimmer of hope on the horizon.

"Actor-turned-Senator Robin Padilla has defended his proposed divorce bill, saying that it aims to protect, rather than destroy, families, especially those in failed marriages.

In a Facebook Live video on Sunday (July 10), Padilla said that the bill, which is among his top 10 priority bills for the 19th Congress, was not meant to destroy marriages."

Snip

"The senator also noted that the Philippines is the only country in the world aside from Vatican City that does not recognize divorce"

Google it. No offense, but I’m not going to spend 30 minutes thinking about, and detailing the process in response to a one post user question. It happens all the time here.

Ours continues to move along, after 5 years.. had the witness interview a few weeks ago and it went well. Remarkable, for almost 20 years after the fact. The witness is someone who knows or knew both parties when they were married and can attest that the marriage was dysfunctional or not consummated, or whatever.

There is also an interview by a psychologist with both parties, then he/she presents to the judge.

And of course the person requesting the annulment goes before the judge at the beginning.

It is at least 6 months between hearings.. and if the judge is out or a pandemic closes the court the delays can get really long. Some of this depends on where the case is filed. Supposed to be where one of the parties lives. Ours is, but it also happens to be a busy court, so more delays..

How would you pick an attorney anywhere? Ask for recommendations from people you trust, and interview them in person.

I like to thank you for taking the time to answer to my question sharing by the way your personal experience.
You already clarify the important steps and show how stressing and long the process might be.
In particular, I am really surprised to learn that after 5 years, your case has not yet been judged. (even if i did not forget the covid time 1f644.svg )
If i can ask and due to this fact, did you overpassed the estimated budget of 300K php?

Thanks. No, we are probably around 240K. At the end, after it is done,  I will give my attorney a nice bonus.. probably 25-50k, for a job well done. Assuming it is.. haha. He is a straight up guy.

Great to know that "delay" is not a pretext to abuse.
Thanks too to coach5" and moondog for their previous replies and have a nice evening.
I really appreciate.

Thinking out of the box, there is an article I read about getting out of miserable marriages.
Something about divorce not available in the country  and annulment being expensive as hell with no guarantee. It is a milking cow in progress which their pathetic court loves. So Philipinos got an alternative to annulment which is somewhat a different opinion.

Here is the link if it is to amuse you.

Are you implying what most other readers think you are implying?

Here in the UK there was a recent newspaper article regarding a spurned woman who resorted to the 'Dark Web' to make certain 'arrangements' 1f60e.svg

Fortunately she was rumbled before the dastardly deed was done.

Do forgive me if I've misunderstood you and got the wrong end of the gun (sorry stick)
