My UK car got it by Belgian car in Brussels - How to claim?

Post new topic

Hi,

My UK car was parked in Brussels while I was away. The guy left his contact and insurance details.

I called his insurance, they refuse to hear me, they told me to go through my insurance. Fair enough I suppose.

I called my insurance in the UK, I have third party, they tell me I can no claim any damage as such. Makes no sense to me, I understand I can not claim for damages I did on my own, but if a 3rd party hits me and acknowledge it was his fault in a letter and on the "constat" and I have his insurance details, why should not be able to raise a claim to get my car repaired and paid by this 3rd party insurance?

Any pointer would be greatly appreciated

Thank you

"hit" even, sorry about that :-(

Hi.

From what you've said, you have 3rd party cover only, so it sounds like there is a clause in your policy where your Insurer has no obligation to chase other 3rd parties on your behalf.  There is nothing unusual about this, when I was a fleet manager I never used our Insurer to pursue 3rd party claims, I used a Law Firm to pursue all 3rd party incidents.  Give your Insurer a callback and ask them to explain why they cannot act on your behalf; assuming they are correct, then ask them if they have any in-house legal advice you can use in order to proceed with your claim.  If they haven't, then a quick Google Search will give you some names of some well-known UK law firms who specialise in this.

I hope this helps.
