Short Stay - Visa C for Family Visit

Post new topic

Guest9742

Hello, hope my message finds you well.

My father had applied for short stay visa on 9th Nov. under Visa C Family visit to Belgium, file was sent to Belgium Immigration on 11th Nov. and after checking on dofi website for the whole month, finally on 19th Dec. we found out the status as REJET/Rejection. The reason of rejection in the letter was only one:

"You have not provided proof of sufficient means of subsistence, for the duration of the intended stay or for the return to the country of originor residence ..."

Documentation submitted:

I had filled-in the 'pris_en_charge' and got my signature verified by the commune (stamped, etc.). Although I knew it might not be accepted, I had read this forum and found out that sometimes it goes without any issues so we submitted anyways, to be on the safe side.

Next, I wrote a "Sponsorship Letter" stating I will finance the whole trip, got it stamped by the commune here in Belgium; submitted hotel and travel reservations (intended date of travel: 27th Nov.).

The visa duration we asked for was 29 days (min. expense per day €95 X 29 days= €2755 for the whole trip) -> my finance statement in Belgium was about €6700 at the time of application (and remained the same throughthe decision). As I needed some funds here, I didn't send much to my parents.

My father's bank statement submitted: around INR 30k. at the time of application.

He didn't submit his ITR and the property documents as I was the one sponsoring (=>doesn't make sense).

My father submitted a letter stating his travel itinerary, stating his son will finance the whole trip; mentioning explicitly that he will come back to his wife (my mom) after the visit => family ties.

He also submitted my Apostled birth certificate=>proof of family relation

He had submitted my current and past work contract for 2 years (contract ending on 31st May 2023), my 6 months payslips, 6 months bank statement (monthly balance went never below 4000€).

He has traveled to gulf countries before -> tried submitting the entry/exit stamps of travel (proof that he did not overstay) as in the passport but unfortunately, VFS refused to take them.

We are really scared applying for the second time as we might think he got rejection for the first time so the Immigration will reject again.

Could people reading this thread please provide some clarity or correct way out of this situation.

My parents are retired and they depend on me financially as I send them ~2000€ /month for family support (WISE, worldremit, etc). My parents have land and property in their name also.

Next time, we plan to submit family visit visa application for my mother and father both this time-> should both of them individually have the min. INR 10,00,000 balance? Or should they just submit a normal Tourist visa application without mentioning me-> this time for an even shorter duration of 7-10 days?

Any suggestions/comments on the possible way forward will be highly appreciated :)

Thank you in advance and a happy new year 2023!

Hello dear Guest that will maybe read the answer.

As I already said thousand of time in the last couple years, to get a visa C

* proof the reason of the trip (family visit ==> invitation letter from you + proof the family link, birth certificate, blablabla)

* how HE is going to pay, NOT you (bank account, saving, job, pension, ...)

* proof they'll go back home (house/appartment/ownership, boat, car, job, any reason for the immigration to say: there's no doubt, they'll come back and won't have a better life in Belgium)

Tip: Next time he goes to VFS, he told them to shut up and take the file as-is to the embassy because you need these documents to be submit in order to proof what you're stating in the document / invitation letter / etc...

As your father has been denied once, you should avoid doing a trip with the mother until he get his visa.

Next time he apply, application will be automatically send to the immigration again and they'll check how he got the money on his bank account etc...

I invite you to read the huge number of other threads talking about it.

Hello,

Currently i am A card holder and wanted my mom to visit us in Belgium, i am not sure which type of visa should i apply for her family visit or tourist visa?

For family visit i will not be able to get annex 3bis or sponsership document as i am on A card not permanent resident.

From the website i found these requirements for family visit. I have added comments how i can arrange them.

Private/Family visit visa

Schengen Visa for Family / Private Visit

1) A valid international passport (the validity of the passport has to exceed the end of the proposed trip by at least 3 months) + copy of the used pages of the passport + 1 copy national ID-card + copy of the used pages of your previous passport (if you have one).

No Issue

2) 1 visa application form + 1 recent passport photograph.

No Issue

3) Proof of employment and proof of leave.

My mom is a house wife so no employment contract.

4) Ticket reservation.

Can reserve a ticket w/o paying as it is not guaranteed that she will get visa

5) A valid Int. Travel Insurance Document + 1 copy. The amount insured has to be minimum 30.000 EUR (equivalent in PKR) insurance has to cover the whole Schengen territory as well as the whole duration of the sojourn in Schengen territory. If the insurance cannot be obtained in Pakistan, one should obtain insurance from Europe.

Checked AXA website it costs 62 euros so no issues.

6) An original sponsorship form (annex 3 bis) from Belgium: recommended.

Will not be able to get as i am currently A card holder, living in Belgium for past 4.5 years. I see it is recommended but not sure how important it is for the visa.

7) Copy of the ID card of sponsor.

No issue, i can provide mine.

8) Proof of solvency of sponsor (sponsor must prove minimum revenues per month of 1.000 € increased by 150 € per person under his charge and 200 € per person invited. If the sponsor is a family member of the applicant basis is 800 € plus 150 € per person under his charge and per person invited). Therefore we need the Family Composition of the sponsor and also the last Income Tax Papers of the sponsor.

No issue.

9) If applicable, proof of family ties (copies of birth and marriage certificates etc.), or a letter of invitation with a detailed description of the ties between the host and the invited person.

Birth certificate and family relationship certificate can be provided to prove she is my mother.

10) Proof of personal financial means:

Credit card + 1 copy

Personal salary slips (12 months)

Personal bank account statements (6 months)

Additional documents may, where appropriate, be required. Presentation of a complete file does not necessarily mean that a visa will be issued. Applications have to be transmitted minimum four weeks before the actual travel date.

She don't have credit card and do not use bank card much as well, If needed i can transfer 100 euros x 30 = 3000euros equivalent to her account before visa application.

Additional details:

  • She have been to Dubai and Saudi Arabia without over staying.
  • Own two apartments in home country.
  • Husband is not applying for visa so she will travel alone.
  • Every year we visit home country but this year my wife is pregnant so we are inventing her instead of going, we can provide travel tickets that every year we go to home country but this year we want her to visit. This is the motivation for visit.

I know that no one can provide a definite answer just wanted to ask everyone based on their experience.
