Property marker

I have a property in Hungary and my question would be to find out if I can put a marker on it if someone tries to sell it ect with out my knowledge.  I know this sort of thing exists in the UK . And any recommendations for a property solicitor. 

Any help greatfully received .

Are you registered in the property register as the or part owner? 


If so, no-one can sell it without your say so.


You can get a copy of the property registry entry online but you need to speak Hungarian to navigate it as it's unfriendly language wise. And you have to pay for these copies.


We had a property dispute with our neighbour and had to get copies of their entries so we could identify who was legally responsible.  It was surprising what we learnt.

Property registration similar to other countries, but where criminals sometimes forge powers of attorney etc to fool the registrar. So there's sometimes a service available where you get notified if there are any proposed dealings in your property.

That's very unlikely as it would need to be done in front of a lawyer and notary, in person, and with all the participants ID documentation - passports/ID cards etc.  And there are taxes to pay which have to be paid by bank transfer.  I'd say it's almost impossible to forge all that and avoid traceability unless it was done by a crooked lawyer.  And it takes months and months to achieve anything at the property registry office.   


One thing which is common in a lot of other European countries is that if a person's name is in the record, that person is considered the owner.   That's even if they are holding it for someone else through some external arrangement.


The property register entries are quite interesting - names, addresses, loans/liens, dates of birth, former owners etc.

What can I say, Internet is strong and things can be found out easily. Why not to be honest and straight forward. VERY suspisious topic.


Rules are I think honest and straight forward in Hungary (for Real Estate), if somebody would like to avoid, to say tricky at least.

I'm not sure why it's a suspicious topic . I purchased a house with my then partner.  I want to avoid this being sold with out my knowledge and recoup the funds .I just want a marker on it rhe same as uk property and looking for a lawyer to deal with this for me .

If your name is in the property register, then your partner cannot sell it without your permission. 


It is however possible that the former partner could sell her share to someone else.   You can do the same.


Look at the purchase contract. If you are both named on there, then you are both owners. 



We tried to do something similar to what you are proposing because of a dispute with the neighbour (they had 30+ m2 of our land).   I wanted to block any sale or division of the land under dispute.  Our lawyer told us that it wasn't possible.   



You really need a lawyer to act for you.  If it's a heated break up, then the lawyer isn't going to be encumbered by the ongoing emotions and should act objectively for your interests.   It was helpful for us because our neighbour is about 80 years old, awkward as hell and very unreasonable.  We couldn't deal with him without wanting a meterorite or lightning to take him out.



BTW, if your partner has another property, you could consider a swap or some adjustment of property holdings plus cash.  This sort of thing goes on all the time.

Easy for me, the remark partner at the time, what is about life commitment? No sympathy at all (good and bad times).

Of course we have good and bad times, but when with your partner there has to be something good,

Easier if one of you die, what is this about divorce/seperation, I do not understand.


For Steve, can you say why you want to do thing off record. (I do not like that at all)

You chose your partner in the past, why not being loyal.

Is there? I have had a number of properties in the UK and so have my family, even second homes and have never needed "a marker"!

If your house in the UK (and Austria, pretty sure the same will be in Hungary) is in both names, the other partner can NOT sell it without your permission unless they are dead of course or there is a court order to do so.


A side note, why don't you seek advice from a lawyer instead of asking legal matters on a forum from Joe Public? I have a solicitor in both the UK and Austria just because I have my property here.

I agree, get a lawyer. 


If it's civil war between a person and their partner in  breakup, clear heads are needed to keep it under control.  If there are kids involved, it's even more difficult as they cannot be turfed out of the family home which is fair enough.


While the HU language is unfathomable to most, anyone with some knowledge knows  there are also some cultural and subtle cues non-native speakers won't pick up on.   Lawyer will be invaluable to get through these nuances.
