Apply Dogital Nomad Visa again in Brazil

Hello,


I'm in Brazil with Digital Nomad Visa (VITEM XIV) now.

I already extended this once so I could stay for more 12 months.


I'm thinking that I would stay more next year.

This VISA is valid for till 2 years at maximum.

But if I apply again and repeat to get it in Brazil, I wonder if I could live in Brazil forever.


Is this possible?

Or do I have to go out of Brazil once?

Or is there any limitation about this?

It's very hard to tell at this point, since the visa/authorization of residency is for a period of two years, and the program is less than three years old.  Digital Nomad status is characterizes as "temporary", and the governing regulation (https://portaldeimigracao.mj.gov.br/pt/nav-guiada/rn-45) says that the residency period can be renewed for an equal period upon presentation of the required documents (Art. 6), but it doesn't say anywhere that it can only be renewed once.


Unless some additional guidance of which I'm unaware has been published, or is published in the future, we'll probably only find out when people start going to the Federal Police for their second renewal, and are allowed to request it or denied.

If your plan is to try to renew indefinitely, please keep several things in mind:


  • ALL of your income must continue to be foreign-sourced.  If you're ever discovered to have any Brazilian earned income, your Authorization for Residency will probably be canceled;
  • Every time you renew, you're probably going to need a fresh, apostilled criminal background check from your home country.  Keep that timing in mind when you schedule your visits home.
  • If you're in Brazil for 183 or more days in any calendar year. you're liable for income tax.  If your foreign income is taxed at the source your Brazilian tax liability may be minimal, but the longer you're here, the more likely it is that the PF will ask to see you Brazilian income tax declaration.  This won't be to check the numbers, but just to make sure you're filing.  If you have a Brazilian bank account, you've probably already experienced this.
  • The Digital Nomad program can be canceled anytime.  If it is, you'll probably be allowed to complete your approved residency at the time that the cancelation is announced, but won't be permitted to renew again.

Just one correction: For renewals you normally only need to upload the background checks from where you were resident during your residence permit (your state level and state federal within brazil) and your own signed declaration for elsewhere.


  • Declaração, sob as penas da lei, de ausência de antecedentes criminais em qualquer país, nos cinco anos anteriores à data da solicitação de autorização de residência.


  • Certidões de antecedentes criminais ou documento equivalente, emitido pela autoridade judicial competente de onde tenha residido durante a autorização de residência de temporária.
