Minimum probation period

Hello,


Posting for a friend.


As I understand as per Bahrain law the minimum probation period is 3 months.


During the employment contract signing, the probation period that is mentioned in the contract is only one week.


Negotiation was tried in order to change the probation period in the contract to 3 months, also mentioning that 3 months is standard as per Bahrain Law. But the employer replied that 1 week is the standard probation period in their company and mentioning that it is also as per Bahrain law. With this, and as the person is in need of work, the contract is signed.


However, after one month of working the person is deciding to resign due to the working environment.


With this I hope anyone can answer some queries below:


  1. I believe the one day notice period will not apply anymore since it is past the probationary period as per contract signed (1week). With this, will the employer have the right to refuse the resignation and hold departure, blacklist the person, or file legal action should the person not be interested to work anymore?
  2. Aside from the payment to be paid to the employer which is the cost of mobilization and visa fees as mentioned in the contract, will the employer force the person to pay the full remaining contract? (Ex one month salary x remaining 23 months) - for 2 years contract period
  3. As mentioned in the contract, the person cannot apply to a related job similar to the current work(nurse) for at least one year in Bahrain - is it strictly being implemented in Bahrain?
  4. any other issues or fees that we should be aware of before proceeding with the resignation?
  5. Will this (resignation) be a very complicated matter to pursue?

You signed a contract which makes it official that 1 week is what you agreed with the employer. If you plan to complain they will show that you signed a contact agreeing to 1week.
